Ruling on PCR tests for travelers affects all decisions due to the pandemic, says Minsalud

The National Government stated that the guardianship ruling that requires the authorities to resume the PCR test for covid-19 as a requirement for those who enter the country, affects the decisions made in matters of health for the entire population.

“(…) Guardianship is an individual right protection mechanism, in this case the judge’s decision is of a general and collective nature, affecting the totality and globality of public health decisions that are not necessarily individual, but rather which are generally collective insofar as they affect the entire population, “said Health Minister Fernando Ruiz this Wednesday.

And he pointed out that “the right of an individual generates situations in which collective actions and public health could be affected.”

For his part, President Iván Duque pointed out that the decision is not part of any improvised reaction of the Government but rather of the monitoring and follow-up of the team of experts who advise the Ministry of Health.

And he recalled that the World Health Organization, WHO, and the Pan American Health Organization, PAHO, have been clear in their guidelines around these requirements.

He said that these organizations do not consider isolation for 14 days necessary for those who arrive in the country, unless the people have symptoms. And he emphasized that this decision is autonomous.

Minister Ruiz also pointed out that the guardianship ruling, even in the first instance, is not possible to comply with, because this type of measure implies coordination between entities, and that these must take into account the plans of those who have already acquired tickets to enter Colombia .

He confirmed that the requirement of proof to enter Colombia cannot be indefinite because it would affect work, and indicated that this type of decision needs epidemiological support.

When the judge’s decision was known, the leader of the Health portfolio explained that for now the PCR test for covid-19 will not be required of travelers entering the country, because the Government sent concerns to the judge about the determination made of demand the negative test result again.

At that time, he emphasized that it makes no sense to limit the right to mobility of people, or impose a restriction for an indefinite period, because the virus is circulating throughout the country.
