The process against former president Álvaro Uribe Vélez has not yet passed from the Supreme Court to the Attorney General’s OfficeTherefore, for now it is not possible to resolve the request of the lawyer Jaime Granados to grant immediate freedom to the former senator.
This was pointed out by sources from the Prosecutor’s Office who insisted that it is not possible to process this request without the process having been formally delivered.

They added that once the voluminous file is delivered, such requests will be studied. The Prosecutor’s Office made its first official statement on Wednesday after the decision of the Investigation Chamber was known of the Supreme Court of Justice to transfer the file for the crimes of bribery of witnesses and procedural fraud.

Initially, the accusing entity indicated in a brief statement that it abides by the decision and that once it is delivered, a prosecutor will be assigned who will “assume it with autonomy, carry out the investigative actions and make the necessary decisions with absolute responsibility and rigor, in strict respect by the constitutional guarantees that assist the accused, the victims and others involved ”.

In the statement, the Prosecutor’s Office requested “To the society and the different public actors to respect the autonomous and independent role that the entity fulfills, and each one of the officials as part of the Judicial Branch ”.

The investigating body did not clarify if the process will be assigned by distribution or if the attorney general, Francisco Barbosa Delgado, will use the legal power to assign the processes and will determine which office the investigation will reach.

Attorney General was challenged

This same Wednesday, and without any decision having yet been made in the case, Senator Iván Cepeda, credited as a victim in the investigation against former Senator Uribe Vélez, challenged the prosecutor Barbosa Delgado.

Cepeda told EL TIEMPO that he challenged the prosecutor and his deputy prosecutor, Martha Janeth Mancera, before the Supreme Court of Justice, and added that if the challenge was accepted, it would have to be the same Court, and not President Iván Duque, who will have to advance in the definition of an ad hoc prosecutor for this process.

“We believe that the President has established a public position, which is an open sympathy, taking sides, for former Senator Uribe. In that case, he is prevented from proposing, in an impartial manner, who could act as an investigator in this case, “said Cepeda. And added that After filing his appeal in the Court, all proceedings are suspended until the moment in which it is resolved by the high court.

For his part, former President Uribe trilled this Wednesday: “Freedom is an invaluable asset, but for me honor is the priority, hence the emphasis on testing ”.
