On the night of Monday, December 4, a group of men tried to rob the passengers of a SITP bus in Bogotá. In the midst of these events, one of the thieves was disarmed by a citizen who was on public transport, who with a maneuver launched himself on a thief and managed to take the knife from him. With that same weapon he seriously wounded him.

Sources from the Prosecutor’s Office confirmed to EL TIEMPO that They are collecting testimonies from other passengers on the bus, as well as security camera videos from this sector, located in western Bogotá, in order to identify the man who killed the assailant.

Because it is a violent death, the Prosecutor’s Office has the duty to open an investigation that clarifies the circumstances in which the murder took place. So far the passengers have said that, indeed, the man who died was the one who had robbed them and threatened them with a knife minutes before.

The Prosecutor’s Office not only seeks to identify the passenger who killed the assailant, but also to be able to build a hypothesis of the case in order to establish, then, whether or not to open a criminal process against the citizen.

This will depend on whether the Prosecutor’s Office concludes in what circumstances the events occurred. If it was in self-defense or legitimate defense, the prosecuting body could request that the investigation be closed. And if that investigation is closed, a decision that can only be made by a judge, the citizen would not have any type of criminal record.

But if the Prosecutor’s Office concludes that the defense was not legitimate, because his reaction was not proportional or equivalent to the risk, because the attack or the danger was not imminent, he could decide to bring charges against him, also before a judge.

Everything will depend, then, on the analysis made by the accusing body, specifically a prosecutor from the Bogotá section that has the case, to establish whether or not there are merits to investigate the citizen who killed the robber.

For now, the authorities are still waiting for the man to appear in court to clarify the facts. If he were to show up or The Prosecutor’s Office identifies him sooner, he could be summoned to an interrogation with his defender.
