Prosecutor’s Office challenges the decision not to carry out a civil marriage of two women

The Office of the Attorney General of the Nation challenged the decision of the Municipal Civil Judge 10 of Cartagena, to refuse to carry out the civil marriage of two women, and will go to a guardianship action to protect the rights of same-sex couples.

The control body asked the judge of Cartagena respect for human dignity and guaranteeing the principle of equality for citizens, and recalled that the judges par excellence are those called to respect and enforce the legal system, devoid of all kinds of subjectivities and with absolute repudiation of discrimination and inequality.

Added that the judges must issue their decisions in accordance with the Constitution and the law, and with observance of the jurisprudential precedents such as the decision of the Constitutional Court in Sentence SU-214 of 2016, which recognized marriage between people of the same sex -egal marriage-, without it being possible for a judge to depart from this precedent for reason of their religious beliefs.

The PGN urged the authorities to carry out their functions in compliance with the legal system and respect for the fundamental rights of all people.
