The businessman Juan Víctor Franklin Monsalve was going to pick up his son when a police checkpoint stopped him at the California motel, on the road from Cali to Dagua.
After telling him that he had a warrant for his arrest, they handed him over to a CTI man, hooded him and took him away in a van. Since that June 15, 2016, Monsalve remained kidnapped for 61 days, while his wife was asked for 5 million dollars for his ransom.

An informant provided data that allowed the Police Gaula and the specialized prosecutor Victoria Nieto to take up the case and order the interception of two police phones. The technical test made it possible to link a CTI investigator, a former police officer, several uniformed officers and a former guerrilla.

On August 8 of that year, the Army Gaula, in a process that was carried out in the office of the specialized prosecutor Silvana Uribe, rescued the businessman.
But the case, considered successful, ended up becoming a war between officials who accused themselves of ties to one of those involved in the kidnapping, procedural fraud, constraint and even threats.
Imputation and video
The confrontation revolves around Cristian González Valencia, a CTI investigator, who on April 30, 2018 was sentenced to 28 years for the aggravated extortionate kidnapping of businessman Monsalve, theft and embezzlement for use.

EL TIEMPO established that the prosecutor Victoria Nieto, who obtained at least 8 convictions within the process (including that of the CTI official), It is summoned to imputation with an assurance measure, on November 9.
How did the prosecutor Nieto go from accuser to accused?
A year before being sentenced, Cristian González denounced her. He said that they offered him a principle of opportunity in exchange for giving information against the prosecutor Silvana Uribe (who participated in the rescue) and other officials.

And his complaint was joined by that of another involved in the kidnapping: Juan David Rengifo. He was convicted of qualified and aggravated theft (for stealing the kidnapped car) in exchange for pointing out others. But now he says that prosecutors Victoria Nieto and Iván Aguirre forced him to say that there was going to be an attack against Nieto and that the person who gave the coordinates was prosecutor Silvana Uribe.
EL TIEMPO located prosecutor Nieto, who admitted that he asked Cristian González if he knew prosecutor Silvana Uribe. But he said that the question was based on a video where prosecutor Uribe is seen speaking with Cristian González on the day of his capture.

And he added that in the interceptions – which allowed the convictions – it was implied that those involved had access to the file kept by the prosecutor Uribe.
“There was no constraint and Juan Carlos Sandoval, lawyer for the convicted Cristian González, has already confirmed that”, Nieto said.
And he added that he did not take for granted the alleged closeness between the convict and the prosecutor Silvana Uribe. And neither did what Rengifo said about the attack. He simply asked that both versions be investigated.

“It is a revenge against me, I did not commit crimes. I filed a complaint with the attorney delegated to the Court the case so that the conduct of the prosecutor who is citing me for indictment, the prosecutor Silvana Uribe and others involved is investigated and they have even inspected the process, “he said.
The prosecutor Uribe speaks
EL TIEMPO also located prosecutor Silvana Uribe and began by attributing her recent transfer to Tumaco (on September 30) to the complaint against prosecutor Nieto: “There is no other reason why, in one year, I have been moved twice. She constricted and manipulated two testimonies and offered benefits to speak against me. “

However, he admitted to having ties with the convicted Cristian González. But he said it was a former co-worker whom he had met on the day of the capture: “It is possible that a telephone was provided for him to call his mother or his lawyer, I do not remember.”
He also said that Cristian González’s attorney was wrong when he said that his client was not constrained: “He said it under oath and there was the attorney Liliana Campo, who contributed to the complaint.”
And she has already put a guardianship to stop her transfer, because she says that in Tumaco they cannot protect her from the threats she has received.
The fight reached the office of the Attorney General, Francisco Barbosa, who on June 2 denied Victoria Nieto’s request that a prosecutor be reassigned to her case, arguing that he had no guarantees of objectivity and impartiality.
According to Barbosa, the Cali sectional leadership had already made that assessment and denied the reassignment. But he ordered that this section carry out a strict follow-up, control and evaluation of the investigation and render periodic reports to the delegate for citizen security.

As for Uribe, the Prosecutor’s Office reminded her that one of her transfers was from the previous administration and that she was sent to Tumaco due to service needs.
