On the afternoon of this Tuesday, the Attorney General’s Office issued a statement confirming that Rodrigo Londoño Echeverry, head of the FARC party, and Senator Julián Gallo Cubillos (Carlos Antonio Lozada) will be called to render a sworn statement.

(Also read: ‘We are not going to resign from the Senate’: Carlos Antonio Lozada)Londoño will be heard on November 4 at 9 in the morning and Gallo, on November 5, at the same time.

The appeal of justice has to do with the statements made in recent days, in which they claim responsibility for the assassination of the conservative leader Álvaro Gómez Hurtado, which occurred on November 2, 1995.

“In compliance with the constitutional duty to investigate crimes, the Office of the Attorney General of the Nation will continue with the taking of evidence, tending to clarify the facts, the authors or participants where Dr. Álvaro Gómez Hurtado and his assistant José Huertas Hastamorir died, in line with the principle of harmonious collaboration that must exist between state institutions, “the statement reads.

Rodrigo Londoño, known by the alias ‘Timochenko’ in his lifetime as a guerrilla, initially acknowledged in a letter sent to the Special Jurisdiction for Peace (JEP) that this guerrilla group had ordered the death of Gómez Hurtado.

The JEP announced last weekend that, through a letter, representatives of the former FARC secretariat offered to “provide the truth, clarify the events that occurred and assume responsibility early” in the homicides of Gómez Hurtado, of General (r) Fernando Landazábal, the peace activist Jesús Antonio Bejarano, the representative to the Chamber Pablo Emilio Guarín and the ex-guerrillas José Fedor Rey and Hernando Pizarro León-Gómez.

(In context: ‘Order to kill Álvaro Gómez was received by’ Carlos Lozada ‘from’ Jojoy ”)

It will continue with the practice of tests, aimed at clarifying the facts, the authors or participants where Dr. Álvaro Gómez Hurtado and his assistant José Huertas Hastamorir died

For his part, Julián Gallo, ‘Carlos Antonio Lozada’, acknowledged in an interview with The viewer, what he executed the assassination, following orders from ‘Mono Jojoy’.

Arguments that support the decision

EL TIEMPO learned of a 6-page document in which prosecutor Elba Beatriz Silva Vargas, a delegate to the Supreme Court of Justice, argues the call for a statement by those mentioned.

It indicates that the measure is taken based on the statement issued by the JEP on October 3 and that, in order to clarify the material truth as the primary purpose of justice, and without interrupting the jurisdiction of the JEP, by virtue of the principle harmonious collaboration between justices to address the investigative hypothesis and determine the authorship or participation of the FARC in the murder of Gómez Hurtado “With respect to those people who do not hold the quality of appearing before the JEP or who, having had it, to date, lack such status“.

In this context, the prosecutor ordered the taking of the following tests: Obtain a copy of the Judicial Police reports on the information collected – at the time – and the activities of the urban network of the Frac, opposite Antonio Nariño.

“This act of investigation will be carried out by means of inspection procedures and field work that are necessary without affecting fundamental rights,” reads the document, which indicates that the Judicial Police group of the Delegate Prosecutor’s Office is commissioned before the Supreme Court by a term of 30 days.

(We suggest: The controversy that was formed in Congress by Lozada’s confession)

This act of investigation will be carried out through inspection procedures and field work that are necessary without affecting fundamental rights.

In the same way, a judicial inspection will be carried out to the Specialized Directorate against Organizations of the Prosecutor’s Office to verify the information collected on Jorge Briceño, alias ‘el Mono Jojoy’, who on the date of the events was a member of the Secretariat.

The objective: is to establish any link between the late guerrilla and Gómez Hurtado. For this purpose, a Prosecutor was commissioned who will support the diligence for 30 days.

With Londoño’s affidavit, it is sought that he explains all the background in his statement – in the letter sent to the JEP – that “we are solely responsible for his death,” in reference to Gómez Hurtado. And the pronouncements made on the subject appeal to Álvaro Leyva and the media.

In the case of Julián Gallo, to explain his statements to The viewer, in the sense of confirming that he ordered the murder of Gómez Hurtado.
