A historic ruling by the Fifth Oral Administrative Court of Cúcuta, ordered the National Police not to use electric pistols type ‘Taser X2’ in the peaceful protests scheduled during the months of October and November. The measure only covers Police officers in Norte de Santander.

In the ruling issued in the first instance by Judge Jenny Lizeth Jaimes Grimaldos, it is ordered to withdraw these electrical control devices for two months. The judge determined that it was not appropriate to apply the decision to the entire country.
“Order the National Police to refrain from using electronic control devices, as for the case it is the ‘Taser X2’ type, by the police members of the specialized intervention devices such as the Mobile Anti-Riot Squads, in the event that the need for their intervention arises due to riots, riots and other situations of violence, “the ruling indicates.

The restriction must be applied to the entire country, it does not make sense that rights continue to be violated in other protests in Colombia
The guardianship was filed by the Departmental Network of Human Rights Defenders Corporation (Corporeddeh), Asonal Judicial, Sintragasolina, the Union of Penitentiary Employees (SEUP), among others; against the Ministry of Defense and the National Police, requesting the suspension of these pistols in demonstrations and in any police action.
The legal action was admitted at the end of September, amid the indignation generated by the death of Javier Ordóñez in Bogotá, and the complaints of police abuse with electric guns in other cities.

Enrique Pertúz, representative of Corporeddeh, described the decision as “historic” and pointed out that the judicial action seeks to generate a debate in the different instances of Congress to regulate the use of electric weapons.
“The restriction must be applied to the entire country, it does not make sense that rights continue to be violated in other protests in Colombia. This should open the debate in the Congress of the Republic,” said the social leader.
For his part, General Óscar Atehortúa assured that they will use the necessary mechanisms to take the pertinent legal actions.

During 2020, in Cúcuta and Norte de Santander there have been multiple peaceful protests of national and local order, these have not left protesters injured or killed.
