The former senator did not reveal the name of the alleged perpetrator and gave few details of the conversation they had. One of the revelations that the alleged person responsible for the assassination made him was that at that time he belonged to the “team of Carlos Antonio Lozada, of a group called Ruan.”
The former senator said that the alleged material responsible for the assassination “is currently alive and will be able to give his testimony before the JEP” and would have said that “the former FARC chief, today senator Carlos Lozada, had contacts with military intelligence.
This Friday the Special Jurisdiction for Peace reported that it denied an appeal for reconsideration with which the family of politician Álvaro Gómez Hurtado was opposed to Senator Julián Gallo, alias Carlos Antonio Lozada, and Timochenko giving free versions of the assassination of the conservative leader .
The hearings that were scheduled for November 4 and 17 and that had been postponed due to the appeal, were changed to next December 10 and 11 at 9 am, respectively. This will be at the JEP facilities in Bogotá.
In the tutelage they presented, they said that the rights of access to information and the truth were violated, so they asked the Jurisdiction to give them the information that the ex-guerrillas provided about the crime that occurred in 1995 in Bogotá.
For its part, the Jurisdiction said that “the collection of information by JEP does not invalidate, nor does it affect the actions of the Prosecutor’s Office, which can assess the information collected according to its own hypotheses,” warns the Reconnaissance Chamber. In addition, it states, the Attorney General’s Office “will retain jurisdiction in those cases that do not correspond to the jurisdiction of the JEP”, either due to lack of relationship with the conflict or by civil third parties who have not availed themselves of the jurisdiction.
Álvaro Gómez’s family rejected the former guerrillas’ decision not to appear as witnesses before the Prosecutor’s Office, arguing that the events occurred within the framework of the armed conflict, which would make the case fall directly under the jurisdiction of the Special Jurisdiction for the Peace.
“This reluctant and suspicious attitude only hints at the existence of a strategy to maintain the crime of Dr. Álvaro Gómez Hurtado (RIP) in total impunity, under the absurd understanding that the JEP is its natural judge,” said the family through Join for Colombia.
They also affirmed that, for them, the jurisdiction of the JEP is questionable and that, until now, it has not acquired prevailing jurisdiction, since the first resolution of conclusions has not been issued to determine that the Prosecutor’s Office cannot continue with its investigative work. .
“There is no formal opening of a macro-case that investigates victimizing events of this magnitude. Therefore, the Special Peace Jurisdiction cannot arbitrarily assume a behavior of early contribution of truth as the only input to open a macro case, without doing a due task of contrasting judicial reports, as well as the validly obtained evidence in 25 years research, ”said Join for Colombia.
