On the night of March 9, it was learned that photographer Daniel Alexander Buitrago Cruz, better known as Alex Cruz, was sent to jail by a guarantee control judge, at the request of the Prosecutor’s Office.
The prosecutor in the case argued that it could represent a danger to society, so issuing this insurance measure in a prison would prevent other similar events from occurring.
For their part, both the Public Ministry and the victims ombudsman supported this decision since there is a reasonable inference about the responsibility of the crime. In addition, they explain that there is a possibility that, in freedom, the accused will not appear at the trial.
Through your defense, Cruz, accused of sexually abusing fellow photographer Diana Quirós, did not accept charges for violent carnal access.
This occurred despite the fact that the Prosecutor’s Office presented different evidence, including the medical opinion of the Palermo Clinic to which Diana Quirós submitted, the sexological evaluation and different conversations that the victim had via WhatsApp.

For the prosecuting body, the photographer should serve a sentence of 12 to 16 years, not only for the evidence presented, but also by other testimonies of women who relate situations similar to those that Quirós lived.
However, for his lawyer, there is insufficient evidence to say that there was sexual violence. “The victim could leave the scene if he felt uncomfortable,” said the defense.
Likewise, the defense stated that Cruz does not represent a danger to society because he does not have a criminal record and there is no certainty that possible victims will be able to present themselves later. “If this event is presented, it must be argued in another judicial process, not in a related way,” said the lawyer.

Judge 20 of control of guarantees of the Tribunal of Bogotá accredited the toxicology test and the results of the medical examinations carried out on the victim. The judicial office considered that there is sufficient evidence to connect Cruz as a possible perpetrator of the crimes that are being imputed to him.
The complaint of Diana Quirós
This gives after the photographer Diana Quirós publicly denounced that she was a victim of sexual abuse by the renowned photographer Alex Cruz.
The woman related that last week, on Saturday February 27, she had a wedding in Villa de Leyva, Boyacá, in which she was going to work with Cruz. The night before, he had planned to stay in a hotel room, but the photographer offered him a lodging at his sister’s apartment.
However, this was a hoax and she ended up alone in the apartment with Cruz. At that time he did not see anything bad, because “I had Mr. Alex Cruz in a very good concept, of a good person who boasts of the presence of God in his life and had him in a very good opinion. I felt in company from a friend, really, “said the photographer.
After the tests, it was evident, he added, that he was positive for a drug known as ‘angel dust’
Quirós added that Cruz started preparing some food and they were drinking beer, but he doesn’t remember what happened from then on.
“When I woke up, it was really pure survival instinct, because when I opened my eyes I had Mr. Alex Cruz on top and with his two hands, he had them on my neck, and he was hanging me.”
At that moment she ran out of the apartment and a taxi driver took her to a hotel. There she called the police and an ambulance picked her up.

She was hospitalized at the Palermo Clinic for two days, where tests were carried out to verify whether or not there was sexual abuse. After the tests it was evident, he added, that he was positive for a drug known as ‘angel dust’.
