Patrolman Edwin Caro: Judge decides whether to send Venezuelan to prison – Bogotá

Although the virtual hearing was scheduled to begin at 2:00 in the afternoon this Friday, Judge 79 has not been able to start it because the defense attorney has problems connecting via the internet.

Wilkerson Slyke Hernández Sánchez is accused of the murder of the patrolman Edwin Caro on Wednesday afternoon in the seventh race with 79th street, in the El Nogal sector.

Hernández was accompanying another man, who has not yet been identified, and was captured as they fled after the events in which the 24-year-old police officer was killed during a search procedure.

On Thursday night the legalization of the capture of the Venezuelan citizen was carried out, to whom the Prosecutor’s Office charged the crimes of aggravated homicide, attempted aggravated homicide and illegal possession of weapons.

At this afternoon’s hearing, the judge must define whether to order an assurance measure against Hernández Sánchez.

Once the connection problem has been solved, the virtual hearing against the Venezuelan citizen begins at 3:11.

The judge draws the attention of the accused for the “attitudes that are not in accordance with the solemnity of the act.” He refers to the fact that Hernández, according to the hearing on Thursday, intervened at various times.

“You cannot allow yourself to speak. You do not have to access the microphone, the custodian (defense attorney) must do so,” the judge reiterated, who insisted that the hearing is a solemn act and I laughed.

Immediately afterwards, the prosecutor requests the intramural security measure of the Venezuelan citizen Wilkerson Slyke Hernández Sánchez.

The petition is made for the crimes of aggravated homicide, attempted and illegal possession of weapons to the accused. He considered it a danger to the community.

The prosecutor narrates the events that occurred on Thursday, when the patrolman Edwin Caro, together with José David Carvajalino, carried out a search of Hernández Sánchez and his companion, whose identity is not yet known.

Hernández is charged as an alleged murderer, that is, he would have fired at the police officer and then fled in the middle of a shooting. The Venezuelan was captured near the place, with the support of a policeman who is part of an escort of a caravan of the Presidency of the Republic that was passing through the place.

The prosecutor in the case says that “full identification” of Hernández has been achieved and can say that “he is the alleged perpetrator” of the homicide of the patrolman Caro, as well as the person who flees and then throws the weapon among a gardener.

The prosecutor reveals that in the medical examinations carried out on Hernández it was found that “in his body there were several projectiles housed” from previous events.

“That makes us think that it is not the first time that Mr. Wilkerson Slyke Hernández has presented himself to situations like those that occurred on March 10,” says the prosecutor.

At the hearing, it is stated that the accused does not have a place where he can be located and that there is no address or telephone information. It registers three migratory movements: two in 2018 and one in 2019, and at this moment it is illegal.

“Mr. Wilkerson, apart from not having roots in Colombia and not having a place of work, it is clear that he has the facility to leave the country permanently or even to remain illegally,” the prosecutor said.

The eyewitnesses in the case are José David Carvajalino, a partner of the patrol car Caro, and of the police officer Johanatan Andrés Baquero, and citizens of the sector where the events occurred.

The representative of the Public Ministry says that in the household bag that Hernández and his partner did not carry food, as was thought, which seemed suspicious to the police officers and that when they were about to check another pocket, the two men took out of the suitcase two weapons and, without a word, they operated. A bullet wound struck Patrolman Caro in the face. And there are marks of a gunshot on the other policeman’s uniform.

According to the Office of the Attorney General, based on the evidence in the case, it is possible to infer Hernández is responsible for the crimes for which he has been charged.

The official also points out that the accused is a danger to society.
“We are clearly facing a highly violent and disrespectful behavior against the fundamental right to life and the Colombian authority,” he says, adding: “We are facing an absolutely malicious conduct.”

He says that the attack on the police officers sought to “evade” the fact that they were carrying weapons. The delegate asked to impose on the defendant “a measure of assurance of preventive detention.”

The defense attorney, Víctor Chaparro, who was assigned to the case, said that he “did not find a single piece of evidence regarding a direct witness to the murder charge and that indeed Mr. Wilkerson Slyke Hernández shot the agent, who unfortunately and sadly lost life, “he said. And he added that at the hearing on Thursday “it was practically an incrimination of the authorship of the facts.”

He also said that it has not been proven at the hearing that Hernándes, who, according to the lawyer, was on the motorcycle grid, is a danger to society.

Given these facts, he requested that a non-custodial assurance measure be declared for his client.

The judge in the case recalled that the defendant had declared that he did not shoot at the patrolman Edwin Caro but was his companion.
