Martín Elías: report of the expert against driver Armando Quintero – Barranquilla – Colombia

A little over a month after the four years since the tragic death of the singer Martín Elías Díaz, EL TIEMPO learned new details that reinforce the position held by the Prosecutor’s Office that it was a culpable homicide for speeding.

In this process, the one designated is Armando Quintero, who was driving the vehicle in which the young artist was traveling with another group of three people, on the San Onofre (Sucre) -Lorica (Córdoba) road.

Well, in the third session of the oral trial that seeks to clarify the events that triggered the death of Martín Elías, an expert surveyor from the elite group of the National Police Traffic Directorate provided the exact details of the accident.

In the course of the interrogations, the expert witness delivered 15 results of the investigative activity, which was carried out since April 18, 2017. Among the conclusions of this work, the following stand out:

“The exact sector of the accident has a maximum operating speed of 50 kilometers per hour.” In the previous session of the oral trial, the accident reconstruction expert concluded that the vehicle was traveling at an approximate speed of 152 km / h.

From the beginning of the evidence to the final position of the vehicle, it traveled a total distance of 212.55 meters.

Additionally, it is stated that the car practically flew: the sum of the spaces between the tracks left by the vehicle, which indicate that It was moving through the air, giving a total of 75 meters 38 centimeters.

Other results

Another of the results presented by the expert witness in the last oral trial indicates that the sector where the event occurred has a straight line to the accident site that is at least 8,000 meters long, “which is often monotonous when driving.”

In addition, from the sector known as Tolú Viejo to the accident site there is a distance of 34 kilometers. This section presents several sectors with deformations in the asphalt layer, gaps, fragmentation, undulations and others, which generates an unsafe traffic through the sector.

“The accident sector presents a hole 12 × 25 centimeters and 5 centimeters deep, on the middle part of the right lane, towards Tolú Viejo-San Onofre, against which the left tires of the truck impacted,” the report states.

The last three points of the report’s results describe other characteristics of the section that condition driving and demand greater responsibility from the driver.

More details of the process

The position of the Prosecutor’s Office is opposed by that of the defense of the driver Armando Quintero, who intends to show that the death of Martín Elías was due to medical negligence. To do this, he managed the intention to exhume the body, but the attorney desisted.

The reason, as he explained, is that what is sought to be established in a second autopsy can be determined by questioning the hospital doctors from San Onofre (Sucre) and at the Santa María clinic in Sincelejo, where they treated Díaz.

It must be remembered that in a previous report, subtracted from the data provided by the vehicle’s equipment, the truck was going exactly 159 kilometers per hour until 3.2 seconds before the accident. And that at the time this occurred it registered a speed of 116 kilometers per hour.

The manslaughter contemplated in article 109 of the Penal Code, as perpetrator, carries a prison sentence of 32 to 108 months and a fine of 26.66 to 150 legal monthly minimum wages in force.

There are still several witnesses that remain for the prosecuting body to then continue with the defense evidence. The next session will take place on March 11.
