The Administrative Court of Cundinamarca admitted a lawsuit filed by Jonathan Ruiz referring to the $ 370 million loan that the Government announced to contribute to the salvation of the Avianca airline.
The court document states that “as an emergency precautionary measure, the Minister of Finance and Public Credit will be ordered to carry out the administrative procedures necessary for the Emergency Mitigation Fund to refrain from making the disbursement of the approved loan to Avianca Holdings SA for a value of US $ 370 million ”.
However, in response to the claims of the lawsuit, a request that requested that the Minister of Finance, Alberto Carrasquilla placeholder image, “Report publicly what is the objective analysis that led to approve the credit in question.”
In the same way, the claim that the President of the Republic, Ivan Duque, inform, prior to any disbursement of said loan, on “any possible conflict of interest due to the circumstance that his sister, Mrs. Maria Paula Duque Samper, serves as Senior Vice President of Strategic Relations and Customer Experience of Avianca Holdings SA ”, since no direct relationship was found with respect to the injunction.
About the process, Luis Fernando Ramirez, Researcher from the Sergio Arboleda University, explained that “it is a normal decision within a process that has been controversial, which generates rejection from certain sectors and these people have taken actions before the contentious so that the resources are not transferred” . Thus, he indicated that the parties interested in the loan being given can file an appeal against this decision, so that it continues its course in a period of between 15 and 20 days.
The Avianca case has been the center of controversy due to the fact that the company is domiciled in another country and because there are debates on how to activate basic income on the resource allocation agenda.
On the other hand, the Government highlights the importance of the airline to guarantee the fluidity of national air transport (see Parenthesis).
Faced with the Avianca case, Jose Antonio Ocampo, former co-director of the Banco de la República, has come out in favor. He expressed that “actions are in the queue of priorities; the credits that are granted during the bankruptcy process are relevant, so providing the resources is a good proposition; Colombia could not operate without Avianca ”and highlighted that in the process of restructuring the Bankruptcy Law, a loan is the best way for this company to see capitalization.
At press time, Avianca stated that the disbursement in the United States had not yet been approved.
And the Ministry of Finance assured that, by then, it had not yet been notified of that decision.
