Judge confirmed the acquittal for sexual abuse of the ‘Monserrate monster’

This Tuesday was held a new hearing against the murderer Fredy Armando Valencia, known as the ‘monster of Monserrate’. On this occasion, the judge in the case decided to absolve the accused of the crime of violent carnal access.

Although Valencia had already been convicted of the murder of at least 10 women, whom he buried on the Moserrate hill, on October 13, the 30th District criminal judge acquitted him, as he assured that the evidence provided by the Attorney General’s Office of the Nation were only indicative that the accused may have abused his victims, which means that there is a reasonable doubt.

This decision was appealed by the Public Prosecutor’s Office, the Attorney General’s Office and the Victims Network, but this Tuesday the judge’s decision to acquit Valencia for this crime was ratified, for the same reasons.

It should be remembered that, in the first hearing, the judge said that there were errors in the procedure and contradictions on the part of the Prosecutor’s Office. “If he killed them when they refused to have sex, the question remains whether the women were abused or just killed.”

El Tiempo collects, that the judge said that eight autopsy reports were analyzed that assure that some bodies were in a fetal position and in a state of nakedness. In addition, they showed evidence of sexual crime such as lack of clothing and injuries to the body.

But, according to the judge’s concept, the Prosecutor’s Office did not communicate the relevant facts within the experts’ reports, which pointed to violent carnal access. And he argued that there could be consistency errors.

The Office of the Attorney General of the Nation did not share at that time the assessment that the judge of knowledge made of the evidence presented in the trial. According to the investigating body, the 36-year-old man was convicted in 2017 for the murder of 10 women.

After finding human bones and three more dead bodies, Fredy Valencia was sentenced to 36 years in prison by the Second Criminal Judge of the Bogotá Circuit. He was charged with homicide, disappearance, violent carnal access, among others, in the hills of Bogotá between 2012 and 2014.
