Jaime Saade, the murderer of Nancy Mestre, will not be extradited and would go free

A setback occurred this week in the prolonged judicial process against Jaime Saade Cormane, the Barranquillero convicted of the murder and rape of Nancy Mestre Vargas, which occurred at dawn on January 1, 1994, and from which he fled for 26 years.

As it was known, the extradition, from Brazil to Colombia, of the convicted criminal was stopped for an unexpected benefit: a tie in the votes of the magistrates of the Federal Supreme Court (STF) of the Rio de Janeiro country.

Of the five magistrates, two voted in favor of the extradition of the man convicted in Colombia in 1995 for the crime; However, two other robes deferred from the extradition request, so the decisive vote would be held by the fifth magistrate, who is absent due to a medical license.

As a result, the extradition of Saade, of which the Ministry of Justice had reported last August that “was active”, is suspended – at least for the moment. Likewise, it was learned that, after the magistrates’ vote on October 6, the “immediate fulfillment” of the order of release in favor of Saade was ordered.

“Report to the Superintendency of Federal Police in Belo Horizonte and the Judge of the Eleventh Federal Court of Minas Gerais Section, so that they promote immediate compliance with the release permit issued under the penalties of the law, with the adoption of the appropriate measures before the Secretary of State for Justice and Public Security of Minas Gerais and the director of the Penitentiary of Nélson Hungary ”, was reflected in the Court’s report to the Federal Police, after this week’s vote.

On the other hand, according to the Brazilian criminal system, Colombia has the possibility of appealing the decision of the Court and, therefore, Saade’s freedom, through an appeal called Declaration Embargo; however, it is unknown whether the country will proceed with this legal action.

Meanwhile, Saade still has to serve the 27 years in prison to which he was sentenced in Colombia for the crime of Nancy Mestre.

26 years on the run

It should be remembered that the Barranquilla Jaime Saade was imprisoned in Brazil since his capture in early 2020, when Interpol managed to identify him by a fingerprint on a glass he had used in a public place.

Saade had been on the run for more than two decades, and had gained a new identity in Brazil: he was posing as a doctor named Henrique Dos Santos Abdala, married with two children.

After his capture, he began a legal process in which he was imposed a preventive prison measure in Brazil, which was appealed by his lawyer alleging that Saade would not escape again because he was rooted in that country and the world was in the middle of a pandemic of Covid-19.

His defense requested probation and house arrest, but the judge assured that the fact that Saade had a stable union, Brazilian children, fixed address or work in Brazil are not enough to give rise to the revocation of the prison decree; Furthermore, he said, the Colombian entered Brazil irregularly, with false documents and remained a fugitive for several decades, which is why he is also accused of committing these crimes.
