“I fear for my life”: Luis Gustavo Moreno on his transfer to La Modelo prison

That decision prompted his lawyer, David Benavides, to file a tutela action that seeks to reverse this last determination and “protect his right to life and personal integrity ”.

On December 4, 2020, Moreno arrived deported from the United States, after paying a sentence of 48 months in prison in that country for the crimes of conspiracy to launder money, conspiracy to commit bank draft fraud, and bank fraud. Moreno’s sentence was handed down in January 2019 after he and his partner, lawyer Luis Pinilla, pleaded guilty for having asked the former governor of Córdoba, Alejandro Lyons, for $ 100 million in US territory in exchange for giving him confidential information from a file. against him.

Minutes before being transferred to La Modelo prison, the former anti-corruption prosecutor contacted The viewer and he was categorical in that they want to silence him, that he fears for his life, that it is inadmissible that a protected witness like him who has denounced former presidents of the Supreme Court of Justice could be put in danger in a common jail and not in Cespo, as It had been determined since last year by a judge of the Republic.

“He informed her that they are now taking me to the Model. I fear for my life and my safety there. It is very sad that the judicial decisions are not carried out in Colombia and it is a lie that there is no room for me in Cespo, because there people such as retired general Miguel Maza Márquez have paid their sentences, ”Moreno told this newspaper.

And he added: “I am not asking for preferential treatment, I am not raising my voice to evade justice, on the contrary, I already paid for what I did in the United States, where I was extradited, and I returned to Colombia a few days ago to purge my sentence. In addition, I have a commitment to collaboration that I will honor and continue to tell the country the truth that I knew. For all that I have said, and for what I still have to say, is that I fear for my life at La Modelo ”.

In the guardianship, the lawyer narrates that to make effective the detention of Moreno in Cespo there was a communication crossing between the Inpec and the Police in which the then director of the latter entity, Óscar Atehortúa, indicated that there was no availability since he was 100% occupied. Next, it is pointed out that Brigadier General Norberto Mujica said that Cespo was not a penitentiary or prison and that for these purposes there were 132 places in the country for Inpec to choose.

According to the lawyer Benavides, in La Modelo there are people who Moreno helped to imprison and has been characterized as a place where there is uncontrollable overcrowding, situations of violence and violation of guarantees and fundamental rights.
