In a 26-page decision, the Superior Court of Medellín ordered the immediate release of Antioquia’s governor, Aníbal Gaviria Correa.
The president was in house arrest due to a decision of June 5 of the Prosecutor’s Office, which is investigating him for contract crimes without compliance with legal requirements and embezzlement by appropriation in favor of third parties.
“Oh FREEDOM that perfume the mountains of my land! The horrible night sublime FREEDOM has ceased!” Gaviria trilled after being notified of the judicial decision. And I add:
“Thank you, my God, for bringing me closer with this cross to the pain of so many Colombians.
NEVER, NOTHING, will break my will to serve Antioquia and Colombia. “

The process, as it corresponds to events recorded in 2005, is carried out by the old system in which the Prosecutor’s Office resolves the legal situation of the people and defines whether they are detained or face the investigation process in freedom. Gaviria was suspended and the Government appointed Luis Fernando Suárez to replace him.
The Court reversed a habeas corpus thatThat in the first instance he had denied Gaviria’s freedom in a decision of the third criminal judge of the Medellín circuit for adolescents.
The Court agreed with the governor’s lawyer, who argued that more than 120 days have passed since the arrest and the Prosecutor’s Office has not yet resolved whether to call him to trial or close the process.
“The judge considered that the detention became effective from June 6 and not on August 12, as the authorities indicated. “Default, laziness, negligence or lack of internal communication between departments of the same entity, or external between different organizations, They cannot generate adverse situations for the legal situation regarding the freedom of citizens”Added the magistrate.
The defense of Governor Gaviria Correa told EL TIEMPO that After the decision of the Court, he may be reinstated to the position immediately.
In that the criminal lawyer Pedro Nel Escorcia agreed, who affirmed that the decision is of second instance and is firm so that the president could return to his position and remain free while the Attorney General’s Office continues to investigate.
