The National Penitentiary and Prison Institute (Inpec) reported, this December 31, that Luis Gustavo Moreno Rivera, a former anti-corruption prosecutor, was transferred to the Bogotá prison, La Modelo.

The decision to send the former official to said penitentiary was in charge of the Third Court of Execution of Penalties and Security Measures of Bogotá, an entity that specified that the accused will have to pay the penalty in a special pavilion in order to preserve his security and fundamental rights.

The same Third Court even issued an incarceration ticket in which the pertinent authorities were ordered to take him to said facilities, by determining, in agreement with the investigating body, that a traditional penitentiary would put the former head of the anti-corruption unit at a high level of risk, taking into account the statements he has given throughout the criminal process.

For these reasons, the aforementioned court issued an order which reads that “the director of Cespo must adopt the appropriate measures, in order to preserve the security and fundamental rights of the convicted Luis Gustavo Moreno Rivera ”.

However, the claims of Moreno, the Prosecutor’s Office and the court fell apart a week after the arrival of the pre-appointed, since the then director of the Police, Óscar Atehortúa, forcefully rejected the transfer of the former official to the Study Center, arguing that it was not a detention center, but a training school, so it was not adapted to receive a convicted person by justice. His decision received the support of the director of Inpec.

This, despite the fact that Cespo is currently the place of confinement of General Maza Márquez, sentenced to 30 years in prison for the murder of Luis Carlos Galán Sarmiento; General (r) Mauricio Santoyo, accused by the Prosecutor’s Office of illicit enrichment and money laundering; and Roberto Prieto, who was former president Santos’ campaign manager, accused of receiving money from under the table from businessman Eduardo Zambrano. Piedad Zucardi, Dilyan Francisco Toro, Andrés Camacho Casado, among others, were also there.
