The ruling issued by the Labor Cassation Chamber orders Avianca to pay $ 500 million for damages caused by its actions against the pilots union. There are legal proceedings against Avianca and Efremovich for alleged illegal interceptions of ACDAC executives’ communications.
In its judgment, whose magistrate was Iván Mauricio Lenis, the High Court explains that Avianca violated the right to trade union association, “generating certain and evident damage to the organization”, since its collective bargaining power was diminished “and it seriously compromised its existence and sources of financing ”.
The court explains that the investigation demonstrated the existence of “a line of action” of Avianca “aimed at diminishing the power of the plaintiff union organization, by offering workers better economic guarantees than those obtained through collective bargaining ”.
As a reaction to the decision, the president of Acdac, Javier Hernández, pointed out that this is how the era of Germán Efromovich comes to an end after many disputes where Avianca employees gave up on improving their salaries, as part of the oxygen that the airline received when it was taken by the businessman fifteen years ago.
The ruling of the Supreme Court against Avianca and questioning its bad practices comes at a time when the airline is seeking significant financing through a soft loan from the Colombian government and private banks
