Disciplinary trial begins against police officers for the murder of Javier Ordoñez – Investigation – Justice

At around 9 am this Thursday, October 1, the disciplinary trial hearing began against Police patrol officers Harby Damián Rodríguez Díaz and Juan Camilo Lloreda Cubillos, investigated for abuse of authority and the homicide of law student Javier Ordóñez.

At the beginning of the hearing, both patrol officers stated that they were renouncing the public defender assigned to them, and requested that the hearing be postponed due to not having trusted lawyers. In addition, they argued that the indictment had not been delivered to them

The delegate attorney for the Public Force, Herman Rincón, who is handling the case, denied this request, considering that in a previous email it had been reported that the uniformed men did have trusted defenders, and that they were also notified of this process by mail. He said that the attorney general’s office should avoid delaying maneuvers.

The hearing continued with the reading of the summons to the disciplinary hearing, in which the Attorney General’s Office indicated that the behavior of the uniformed men against Ordóñez was not proportional and that it was irrational.

At around 11 am, the lawyer Jorge Páramo entered the hearing, as Rodríguez Díaz’s trusted defender, however, various connection problems between the lawyer and the prison for uniformed men in Facatativá (Cundinamarca), where they are deprived of liberty the police officers, the hearing could not continue until after 11:45 am

Later, the lawyer Páramo again asked to postpone the hearing, arguing that only until this Thursday had he been appointed as a lawyer and that to exercise the technical defense he should have more time to study the case. That request was also denied by the attorney Rincón.

Within the indictment, the Attorney General’s Office cited that the uniformed officers had to ensure the protection of the citizen, but instead, in the case of Lloreda Cubillos, “apparently he unjustifiably abused his authority. He recalled that in a video that is part of the file it is observed how on more than 6 occasions he was electroshocked with a taser despite the fact that several times the law student said “please no more” and asked them to stop.

Therefore, for the office there was an arbitrary and unfair act, and that what Lloreda did could constitute an apparent disproportionate force, inadequate and excessive that was not reasonable, while Ordóñez was already in a defenseless situation, subjected by the police

It was also recalled that Lloreda had the knowledge and training necessary to operate the taser and had experience in his position, since he had been a surveillance patrolman for 6 years and 9 months. The conduct was also considered to have been committed with intent.

As for the patrolman Rodríguez, the Attorney General’s Office cited that he allegedly kicked and punched Ordóñez, especially within the CAI of Villaluz, which would have triggered the death of the law student.

“Apparently he used force in a disproportionate, inappropriate and excessive manner,” reads the indictment, which states that for this he had committed abuse of authority by arbitrary and unjust act.

It also pointed out that Ordóñez had been the object of an “indiscriminate abuse of authority”, in something illegal and excessive.

“The patrolman (Rodríguez) should have promoted respect for Human Rights but apparently he abused his authority unjustifiably, a situation that according to the concept of this office does not have legitimacy nor was it necessary,” says the indictment.

And it continues: “The uniformed men attacked Ordóñez violently despite the fact that he begged them to stop.”

Around 12:35 am the hearing was suspended until 2 pm this Thursday.
