Court revokes the arrest of General Óscar Aterhortúa and the Defense Ministry Carlos Holmes Trujillo – Services – Justice

The Superior Court of Manizales resolved to revoke an order issued on December 9 by the Promiscuous Family Court of Chinchiná (Caldas), that ordered the arrest for three days of the director of the Police, General Óscar Atehortúa, and the Minister of Defense, Carlos Holmes Trujillo.

The Chinchiná court decision was given in response to the contempt incident promoted by Faiber Jahir Moreno Salazar against the National Police and the Ministry of Defense for the “non-compliance with a guardianship ruling” issued on August 26, 2019, which ordered them to promote the promotion course to Major Moreno.

The breach occurred, according to what is read in that document, because, “despite having been subjected to the professional career evaluation procedure to be called to the promotion course, (Moreno Salazar) was notified on February 25, 2020 that his name had not been recommended to present the competition prior to the training course for promotion to the rank of lieutenant colonel. “

For this reason, Judge César Augusto Cruz had imposed on Trujillo and Atehortúa an arrest for three calendar days “at the Police School or a similar Public Institution in the city of Bogotá”, a decision that was reversed in the second instance by the Superior Court of Manizales.

For now, according to the ruling, “there is no place to indicate any type of sanction for compliance with the sentence.”
