The directors of the exclusive club El Nogal de Bogotá have just been notified of an adverse decision, of the Supreme Court of Justice, related to the terrorist attack that targeted its headquarters, on February 7, 2003, with a balance of 36 people dead and 200 injured.
Although the ex-guerrilla was responsible for these crimes, club members claimed failures in the security of El Nogal, visited by ministers, businessmen and high-level officials.

Gustavo Forero Rubio’s family requested to declare civil and extra-contractual responsibility to the club for having allowed the car with the explosives to enter.

In the sentence, known exclusively by EL TIEMPO, they ensure that, with an authorization from the beneficiary of a business action, They exceeded almost all the safety rules, failing to comply with the obligation to ensure the safety of the people who were in the club.

El Nogal’s defense argued that it was a terrorist act and even obtained a first ruling in his favor, on May 30, 2013.
But Forero Rubio’s family appealed and managed to find the club responsible, which took the case to the Supreme Court, in the cassation court.

In that instance they have just confirmed the ruling that condemns the club to recognize close to 900 million to the family of the victim who was left unprotected.
Other lawsuits on the way
EL TIEMPO established that similar lawsuits pass through other instances, including the Council of State.

Among other things, attention is drawn to the fact that, on the date of the attack, there was no canine surveillance at all entrances and particularly at the door through which the car bomb entered.
The FARC’s forgiveness
And while they admit that the size of the explosive charge and its enormous capacity to generate damage, it was unlikely to prevent the explosion, the failure was to allow the entry of the bomb.
The FARC, meanwhile, asked for forgiveness for the attack and expressed their conviction that the attack was “something unjustifiable.”
