Claro and ETB sanctioned for violating the rights of their users – Sectors – Economy

The Superintendency of Industry and Commerce imposed fines on the companies Comcel SA (today Clear) for 197’505.675 pesos and ETB for 124’648.026 pesos.

After analyzing and evaluating the complaints filed against these companies, it was found that they had not complied with the orders issued by this company. In the first case, it was established that Comcel failed to comply with the orders issued by the Superintendency of Industry and Commerce, through resolutions No. 47242 of August 2017, No. 86214 of December 2017, and No. 79153 of October 2018, which resolved the Appeals filed by users in the processing of claims associated with failures in the provision of voice and data services, the lack of duty to compare payments registered by users with those that are in default and the omission of the expedition of peace and salvation.

In front of the operator ETB, It was determined that he did not comply with the orders issued by this Superintendency through resolutions No. 12951 of February and No. 28991 of April 2018, By means of which the appeals were resolved in favor of the users, ordering “to continue with the execution of the contract in the initially agreed terms and to cancel the packaged service.”

The fines imposed in both cases were based on the violation of the right recognized to users through the resolutions subject to non-compliance, as well as the ignorance of the authority with which this entity is vested.
