The Thirteenth Municipal Criminal Court, with the function of guarantees of Barranquilla, ordered this Monday five days of arrest for the governor of the Atlantic, Elsa Noguera, and the departmental health secretary, Alma Solano.

The measure was taken by the judge in the case for contempt of a ruling that ordered the reinstatement of Alberto Acosta Pérez in the management of the Metropolitan Hospital, which had been issued on July 21, 2020.
This case is part of the dispute that is carried out for the control of the Foundation Metropolitan, which includes both the medical institution and the Metropolitan University, operating in the capital of the Atlantic.
The order was sent to the Metropolitan Police, which must carry it out at the Sijín facilities in Barranquilla.
Likewise, this Court again orders the president Elsa Noguera, the secretary Alma Solano and the judicial representative of the Interior, Paul Zabala, whose arrest warrant also involves him, to “immediately” proceed with the restoration.
Additionally, the Court certified copies to the Attorney General’s Office and the Ninety Delegated Prosecutor’s Office before the Superior Court of Bogotá, so that other public and private servants are criminally investigated.
These people are: Armando de la Hoz Berdugo, María Sobrino Molina, Iveth Candelario Acosta, Luz Silene Romero, Ivonne Acosta Acero de Jaller and Javier Cuartas Jaller.

The foregoing, for the alleged crimes of procedural fraud, fraud in judicial resolution, falsehood in public document, prevarication by action, prevarication by omission, private corruption, abuse of public function, usurpation of public function and association for the commission of a crime against public administration.
Governor Elsa Noguera, Secretary Alma Solano and attorney Paul Zabala can request reconsideration of the five-day arrest measure adopted.
The Governor’s response
In a four-point statement, the Government of Atlántico stated the following:
1. That on July 21, 2020, the Second Criminal Circuit Court with Knowledge Functions of Barranquilla it only ordered the registration of a minutes of the Board of Directors of the Metropolitan University Hospital Foundation of June 30, 2016.
2. Taking into account that the Government did not have this document, Mr. Alberto Enrique Acosta Pérez was repeatedly requested, who did not deliver it, which prevented compliance with the court order.
3. Today the Department of Atlántico complied with the order of the 13th Municipal Criminal Court with guarantee control functions of Barranquilla in the sense of “registering and registering Mr. Alberto Enrique Acosta Pérez as administrative director and legal representative of FHUM”, stating that This is done in compliance with the court order, not counting on the Board of Directors Act dated June 30, 2016, the content of which is unknown to the departmental administration..
4. By complying with the court order, the judge is asked to revoke the arrest measure for overcoming facts.
