Álvaro Uribe: Supreme Court denies him his freedom again

The Supreme Court of Justice once again denied a petition for freedom, through habeas corpus, in favor of the former President Álvaro Uribe, who is under house arrest for the alleged witness tampering process.

The Civil Chamber decided to deny the appeal filed by a citizen and, on the contrary, to leave firm the decision that the Superior Court of Montería in September.

The citizen said that the order of the Court Investigation Room that he had sent Uribe to house arrest was illegal because it had been taken with “illegally collected” evidence.

The Court studied that case and denied the petition because it found no justification in the citizen’s arguments. “He found no irregularity in the controversial decision.”

The man, not satisfied with that decision, challenged it, but his appeal was presented late, that is, after the days required by law to present it.

For this reason, the Court’s decision was confirmed and when the case reached the Court, with a presentation by the Magistrate Armando Tolosa, it was concluded that the man did not file the appeal on time.

“The providence that denies the Habeas corpus it may be challenged, within the following three calendar days (…) not only is it enough to expose the disagreement, but also to do so in a timely manner, ”said the Court.

In this sense, it was found that the citizen presented his disagreement five days after the Court’s decision.

“It is clear that the promoter initiated the aforementioned remedy late, without being received his allegation about the closure of judicial offices on Saturdays and Sundays,” said the Court.

Since Uribe was under house arrest, the Supreme Court of Justice received and denied 400 guardianships requesting his freedom for considering them inadmissible or for lack of legitimacy, because the people who presented the appeal were not part of the process that is being carried out against the former senator.

This guardianship in favor of Uribe was registered after the Chamber of Investigation of the Supreme Court ordered that he should remain at home in jail while the process against him for the crimes of procedural fraud and bribery is advanced.

That process is now in the hands of Judge 30 with guarantee control function, who will have to decide on the release of the ex-president and if the process continues, leaving firm all the actions taken by the Court’s Investigation Chamber.
