The Supreme Court of Justice has just notified the defense of former president Álvaro Urbe of the decision (unanimously) to pass the process for bribery of witnesses and procedural fraud to the Prosecutor’s Office.
Sources from the high court confirmed to EL TIEMPO the notification, which will be made official and in person this Tuesday afternoon.

“Since Álvaro Uribe is covered by the preventive detention insurance measure, replaced by domiciliary detention in accordance with the Criminal Procedure Code applicable to these cases (Law 600 of 2000), it will be available to the Attorney General,” he says. a statement released after the news of EL TIEMPO.
They also said that, with a presentation by Magistrate César Reyes, it was argued that, after his resignation from the Senate, “competition within the process is not maintained.”
In addition, that they are common crimes: “Because they are common crimes and, furthermore, because there is no link of the facts with the functional activity of legislator, or that they were their necessary consequence or the means and opportunity conducive to their execution or deviant or abusive exercise of functions, it was decided to refer the process to the Attorney General’s Office.
The Court makes it clear that the conduct under investigation has nothing to do with his congressional activity, as alleged by the defense of the former president, led by Jaime Granados.

In addition, there was a procedural breakdown, since the case of Congressman Álvaro Hernán Prada continues under the orbit of the high court.
The arguments
Although the text of the decision contained in about 60 pages is not yet known, sources from the high court told this newspaper that, after three sessions in which the case was discussed, the magistrates of the Examining Chamber were inclined to accept the defense arguments.

“As of today, the procedure for the delivery of the file, consisting of numerous notebooks, as well as the copying of multiple magnetic media contained in it, begins,” says the statement, signed by the president of said Chamber, magistrate Héctor Alarcón.

The Prosecutor’s Office and Inpec are also being notified at this time of the decision so that they take the measures within their scope, they explained without giving further details of the immediate decision on home detention that, in any case, their defense may request that it be replaced.
