The Second Municipal Civil Court of Envigado admitted a tutelage of a Venezuelan citizen against the mayor of Bogotá Claudia López, for her recent statements on security and Venezuelan migrants.
Hernando Andrés Soto Valencia, protected by the right to equality and non-discrimination, made a series of demands on López and the Mayor’s Office of Bogotá.

The guardianship asks to order López to withdraw a trill of October 30 in which the video in which he says “I do not want to stigmatize Venezuelans, but there are some immigrants involved in criminality who are making our lives squares.”
The mayoress post says: “Colombian law provides for the deportation of those who commit crimes in Colombia. That law is not xenophobic, it is logical. Asking that it be applied is not xenophobia either, it is using legal tools that we have to guarantee security, coexistence and justice for all. ”

The guardianship also requires the removal of a trill made through the Twitter account of the Bogotá Mayor’s Office on October 29 in which the same message is published:

And, in general, it is asked to order Mayor Claudia López to issue a public apology “and to commit herself and not repeat an act of xenophobia.”
So far, neither López nor the Bogotá Mayor’s Office have commented on the issue. They have a period of two days from the notification of guardianship.

Who filed the guardianship?
Hernando Andrés Soto Valencia, 32, presents himself as born in Caracas (Venezuela), the son of Colombian parents and with a Colombian ID. He is also a lawyer and is pursuing a specialization in administrative law.
“I am not a criminal, nor do I have a criminal record. In addition, I am a Binational Lawyer, I work for a law firm, I am currently studying a Specialization in Administrative Law and I always seek that my behavior as a citizen is the best possible, however, from these statements so reprehensible on the part of Mrs. Claudia López, xenophobic or stigmatizing behavior can be generated against me, “says the lawyer.

Soto, in the guardianship, collects evidence of the mayor’s trills and publications from various media that covered the news. From this, it ensures: “Without a doubt, associating crime with a nationality constitutes an act of
reprehensible discriminationBecause when someone has the status of a criminal, they do not do so by virtue of their nationality, but rather it derives from the loss of values as a human being and not as “Venezuelan”, “Colombian”, “Peruvian”, etc.

Soto adds that “It is strange that it is precisely Mrs. Claudia López who makes these sad statements, since she belongs to the LGTBI community, which remains in a constant fight against discrimination.”
