Claudia Daza: her explosive audios were legally recorded – Investigative Unit

The alleged illegality of the audios in which María Claudia Daza is heard
—Then Álvaro Uribe’s advisor— speaking of contributions to the Iván Duque campaign under the table has been the main argument of members of the Democratic Center to dismiss them.

In addition to pointing out that these are personal conversations (with profanity and lies), they insist that it is not known why it was intercepted. And also, that she had no position in Iván Duque’s campaign for the presidency.

But EL TIEMPO obtained documents showing that a first package of audios, in which Daza is heard speaking With the rancher José ‘Ñeñe’ Hernández of contributions and collection of money for the presidential campaign, they are legal.

In fact, they are the support of the so-called investigation into the alleged illegal entry of money into Duque’s campaign, known as the ‘Ñeñepolítica’, in which the then-candidate Gustavo Petro has just become a victim.

“Yesterday I told Priscila that we have to put the batteries, we have to look for money to pass under the table, to release it in the departments (…) I got a thousand packages (millions of pesos) what I need is some entrepreneurs and one gives them the list. I have a company that gives them the money and nobody will know. “

Indeed, the Supreme Court ordered the interception of ‘Caya’ Daza in the investigation against Álvaro Uribe (his then boss) for alleged bribery in criminal proceedings and procedural fraud.

The aim was to establish if she, in charge of the then senator’s agenda, had had ties with the lawyer Diego Cadena, who was visiting prisons in search of testimonies.

The other interceptions

The order was issued on April 6, 2018 and Daza was heard for a month, a period that coincided with the theme of the campaign.

And although for Daza’s defense, headed by criminal lawyer Iván Cancino, the Court should not intercept people who were not gauged, the law allows it.

But there is a second batch of audios, in which ‘Caya’ Daza leaves his reach within the government, which have not yet been legalized. These were ordered by the Attorney General’s Office.

Talks with power

In these audios, and in some ordered by the Court, ‘Caya’ Daza speaks with the Palacio’s legal secretary, with members of the Centro Democrático party and even with Tomás Uribe, Álvaro Uribe’s son.

“There is no crime in the conversations that are being brought up again. People in their intimate conversations speak certain things and others do not. I repeat that there is nothing illegal and that they simply talked more than necessary,” he told EL TIME the attorney Cancino.

In fact, he points out that it is not true that Daza had met with mayors or with former governor Oneida Pinto.

However, the scope of a person who they describe as a simple advisor draws attention.

Indeed, Caracol reproduced some talks in which Daza spoke with Congressman Juan Manuel Daza, Alicia Arango and with the Palacio’s legal secretary, Clara María González.

Maria Claudia Daza: Doctor Clara.

Clara Maria Gonzalez: What happened, Cayita, I was calling you to tell you that they failed the process of losing the investiture in favor of Iván (Duque), did you hear?

Maria Claudia Daza: What a thrill. Wonderful.

Clara Maria Gonzalez: What a thrill. Imagine, and all the stupid things that Paloma and Barbosa were saying, that precautionary measures, that go against the Council of State, began to trill a number of stupid things, because they only trilled.

Alicia Arango: But what about Ernesto Macías? Send egg. Send egg, right?

Maria Claudia Daza: Macias is a wild card, Ali, he is in cold and warm water.

Alicia Arango: Yes, but it’s really rude, isn’t it?

Maria Claudia Daza: Ah no, rude is because it has no culture, Ali, you understand?

What is ‘Ñeñepolítica’ about?

The most recent action within the so-called ‘Ñeñepolítica’ took place 20 days ago, when the Prosecutor’s Office ordered a selective search, with a view to legalizing the interceptions that the accusing body made of ‘Caya’ Daza.

The defense of Uribe’s former adviser is asking that, before proceeding with the case, it be fully established that her client is the speaker.

And Senator Gustavo Petro appointed a lawyer —Juan Carlos Trujillo— to hear the entire process, in his capacity as victim.
