Luis Andrés was not murdered: the most solid and proven version that does not let the Colmenares family rest

On a day like today, but in 2010, the country’s media reported on the death of young Luis Andrés Colmenares in El Virrey Park in the Colombian capital. This is one of the most mediatic and controversial court cases in the history of Colombia. The magazine Semana made an analysis in which despite the fact that there is countless probative material that shows that Colmenares was not murdered, but on the contrary, he died from an unfortunate accident, it is a truth that currently continues to bother the family and litigant of the deceased youth. Nor is it a conclusion without doubts.

The evidence that confirms that Colmenares’ death was an accident and not a homicide is of all kinds: scientific expert opinions, forensic reports, accounts of all the witnesses, confessions of paid false witnesses, and cell phone analysis of Laura Moreno and Jessy Quintero ( implicated in the events).

The tests repeat and confirm the same thing over and over again: the death of Luis Andrés Colmenares was due to an accident and not a homicide. That was even the opinion that the Attorney General’s Office issued before the case escalated to the media level that characterizes it.

The fact

On December 31, 2010, Luis Colmenares went out to celebrate Halloween night with his colleagues from the Universidad de Los Andes in one of the most exclusive sectors of Bogotá, exactly on Carrera 13 with 84B Street, Zona Rosa. According to the story of Laura Moreno and Jessy Quintero, Laura left at 21:00, in his car to pick up Colmenares from his house in the Quirinal neighborhood, since they had been dating for a month and he wanted to be with him at the Penthouse bar.

Around the 11:30 pm Colmenares and his companions arrived at the bar, and according to Semana Magazine, they turned the truck over to the valet parking service and walked a few meters to the entrance of the nightclub, where they met a college classmate in charge of handing them the entrance passes.

Around the 2:45 am The party ended and Colmenares would have left the bar annoyed by an incident he had inside with Laura Moreno. Once Laura, Jessy and Luis reached the street they found themselves in front of the disco with several friends who still remained. The group waited there for the valet parking service to bring Laura’s truck.

Minutes later Colmenares would continue to be restless and annoyed by what happened and suddenly, with hurried steps, he would have run out and crossed the street to the park in front of the disco He walked diagonally along this street and then took Calle 85 to the west.

At 3:29 in the morning the most confusing and decisive part of the case took place, because according to Laura, she told Jessy on the phone that she had Luis grabbed hold of him, suddenly that he had let go and that she went running, that she could no longer see him and shouting: “¡¡ He fell, he fell, the Negro fell into the pipe! ”.

Towards 4:00 in the morningThe group tried to find Colmenares and even asked some policemen to help him search, which was unsuccessful as they assumed that the young man had returned home.

At 4:19 in the morning Jessy decided to call Luis’s brother from her phone to ask, once again, if he had arrived. Again the youngest of the Colmenares answered negatively.

According to the Bogota Fire Department, it was registered an emergency call at 4:00 am in which the fall of a person in the El Virrey pipe was reported. After 20 minutes of review, from 4:47 am to 5:17 am, the fire department did not find anything in the indicated place.

The strange thing is that the same October 31, between 7:30 pm and 8:20 pm. They conducted a new search and found the body of the young Luis Andrés Colmenares. Oneida Escobar, Luis Andrés’ mother, had gone to the park to look for her son at 6:00 am after Laura and Jessy called Luis’s brother. Escobar initially searched hospitals and police stations. At night, after the insistence of the mother of the disappeared, Oneida Escobar, the firefighters carried out the second search, finding the body of Luis Andrés Colmenares about 120 meters from where Moreno said that Luis had fallen.

“He died by accident and not by murder”

The body was transferred to the National Institute of Legal Medicine and the result of the first autopsy showed that Colmenares had a grade 3 alcohol intoxication, which supported the theory of an accidental death. This theory was never accepted by the Colmenares family, who insist that their crime was murder.

After firefighters found Colmenares’ body in a backwater – a decline in the tunnel – it was declared that the body was there and had not continued in the depths of the tunnel. Legal Medicine delivered the autopsy report and assured that there was water in Colmenares’s lungs, which caused a bronchial aspiration, which indicated that the man was breathing when he fell into the water. When making this clarification, the Prosecutor in charge of the case declared that Colmenares had indeed fallen into the canal by accident, which caused a severe contusion on his skull that allegedly left him unconscious and without the possibility of survival. This statement was not liked by the Colmenares family.

The private coroner Máximo Duque, involved in the Colmenares case, was in charge of exhuming the body and presented a report in which he claimed that the death of the young Luis Andrés was not compatible with a fall from a height (accident) but rather with homicide. These arguments, according to the judge who took the case, incriminated Laura and Jessy, and the versions of them, along with those of ten other university students, were false and had reached a type of “criminal silence”. However, photos of the body were subsequently presented and it was alleged that the Duque coroner’s procedure had been unprofessional, for which the judge ordered that the doctor be investigated both disciplinary and criminally.

After endless technical analysis, cell phone link studies, testimonies from those involved, the revelation of false witnesses and invaluable probative material, The judge confirmed, armed with arguments and evidence, that Luis Andrés Colmenares died from an accidental fall, which led him to drowning and not from murder.

“This office has no doubt that the injuries correspond to a fall. (…) It is proven that (the Prosecutor’s Office) received a process outside of the courtroom, that is, in the news, newspapers, social networks, which revealed something that was never demonstrated in the trial, “he said. the jurist, as revealed by the Semana Magazine.

In the process, in addition, the investigation of the different experts and investigators who worked with the prosecutor Antonio Luis González, who hired false witnesses in the case, was ordered.

The opinion that ensures that Luis Andrés died in an accident and was not murdered continues to cause controversy in the Colmenares family. The victim’s father, Luis Alonso Colmenares, has confirmed over and over again in the country’s media that he will work tirelessly until justice is served and it is proven that his son’s death was a homicide.

“After this sentence there is still impunity, but I will do what is possible to take this to the last instances, so that justice prevails as it should be..
