Cartagena judge sentenced for participation in pension carousel – Crimes – Justice

For its responsibility in the crimes of embezzlement by appropriation in favor of third parties and prevaricate by omission, related to the irregular collection of pensions, the Superior Court of Cartagena condemned, in the first instance, ex-judge Fabio Cabarcas Pardo to 12 years and 8 months in prison.

Thanks to the articulated work of the National Agency for Legal Defense of the State (Andje), the Prosecutor’s Office, the Autonomous Heritage of ISS Remnants and Colpensiones, it was established that during 2010 and 2011 the then judge favored the irregular collection of pensions for $ 40,115,669,468, thus constituting, reported Andje, in the largest case of pension corruption in the country.

As reported by the Agency, as the sixth labor judge of Cartagena, Cabarcas heard several lawsuits against the defunct Institute of Social Security (ISS), which sought the recognition and payment of life retirement pensions, in accordance with Law 33 of 1985.

Although the plaintiffs had already been ordered to pay their retirement pension by their employers, Cabarcas issued decisions condemning the ISS to recognize and pay an old-age pension in favor of the plaintiffs.

The plaintiffs then used the decisions made by the former judge as collection titles to formulate executive demands and thereby pursue an irregular payment. Thus, they managed to receive between 6 and 10 billion pesos each.
