Promotora Calle 47 SAS said, through a statement, that taking the decision to demolish the Aquarela building without a court order being involved “implies assuming the patrimonial responsibility that implies compensating the damages against those affected, who in addition to the builders , includes more than nine hundred families from Cartagena who invested their savings in this duly licensed housing project ”.

The construction company also questions the concept issued by the State Legal Agency and qualifies the arguments presented as “tendentious”.

“The opinion issued by the National Agency for Legal Defense of the State, which is not legally binding, is based on tendentious arguments and leads to wrong conclusions that seriously compromise the patrimonial responsibility of the District and the Nation, and is based on the Study of the Colombian Society of Engineers, whose content has been seriously questioned by various professionals and associations given the methodological and technical failures in which it incurs, ”the letter states.

They add that the process to restore the 619 square meters that today occupy public space has been paralyzed by court orders and administrative decisions of the District. “Attempting the total demolition of the project is a measure that ignores the provisions of the police authority and is completely disproportionate and unreasonable.”

The legal concept that was sent to the Dau administration on September 29 reiterates the urgency of adopting the demolition decision “since such order was issued in November 2018 by the competent district authorities.”

In this regard, Myrna Martínez, head of the Legal Office, indicated that Mayor William Dau has considered availing himself of the criteria set out in the document but is seeking agreement with the Ministry of Culture.

“We welcome the concept of Dr. Camilo Gómez, director of the State Legal Agency, who met with the mayor to share these recommendations with deference. Even the mayor has already arranged a meeting with the Minister of Culture to discuss the matter, ”said the official.

He also indicated that a technical study will be contracted to determine what would be the most successful procedure to demolish the controversial tower.
