Court will continue to prosecute Álvaro Uribe for ‘Ñeñe-politics’ – Cortes – Justicia

This Monday, the Investigation Chamber of the Supreme Court of Justice determined that it will continue to carry out the preliminary investigation that continues against the former president and former senator Álvaro Uribe Vélez for the events known as the ‘Ñeñepolítica’.

The high court established that, despite the fact that Uribe resigned from the Senate, which in principle would imply that he lost competence to continue carrying out investigations against him and would have to send them to the Attorney General’s Office, in this case of the ‘Ñeñepolítica’ it was found that the alleged events did have a possible relationship with the functions of the ex-president as senator.

For this reason, the Court found that it is competent to continue taking the case against Uribe for alleged vote buying in the 2018 presidential campaign, a process that is in the preliminary stage.

According to the Court, the Investigating Chamber continues to have jurisdiction in this case since in that process Uribe maintains jurisdiction for the “alleged active participation of an employee of his UTL in the facts.”

It is about the alleged participation in these events of María Claudia ‘Caya’ Daza, who was part of the Uribe Legislative Work Unit.

In this same process, the Court also carries out a preliminary inquiry against the representative Edward Rodríguez, who, at his request, will be heard tomorrow Tuesday in a free and spontaneous version.

The Court opened this preliminary inquiry against Uribe by the ‘Ñeñepolítica’ last March, after receiving a complaint from journalist Gonzalo Guillén and Daniel Mendoza in which they pointed out alleged electoral crimes. The case is in the office of the magistrate Misael Rodríguez.

In the complaint, some audios from 2018 were attached that were obtained with legal interceptions in which the authorities had tapped the phone of the deceased farmer José Guillermo ‘el Ñeñe’ Hernández, who was being investigated for the murder of Óscar Rodríguez and his possible links with the criminal structure of ‘Marquitos’ Figueroa.

In those audios, alleged money is mentioned “under the table” to, presumably, favor the presidential campaign of today’s President Iván Duque and Uribe is also mentioned.

Although the Examining Room will continue to carry the case of the ‘Ñeñepolítica’ against Uribe, dHe decided to send the Attorney General several preliminary inquiries that he had against him, such as three previous proceedings for libel and slander.

He also sent him a certificate of copies of 2018 when the Criminal Chamber filed a complaint by Uribe against Iván Cepeda for alleged manipulation of witnesses and found that, presumably, the one who was trying to fabricate testimonies against Cepeda was Uribe. That case was also in the preliminary stage and was referred to the Prosecutor’s Office on Monday.

In addition, he decided to send the Accusations Commission a complaint from a former employee of the Prosecutor’s Office, who is in exile, against Uribe.

These decisions are added to others that the Chamber of Instruction had already made in Uribe’s case, after he resigned from the Senate. Due to that resignation, the Court had already passed on to the Attorney General’s Office the firm investigation against the former senator for alleged bribery of witnesses and procedural fraud, as well as the preliminary investigation into the massacres of La Granja, El Aro and the murder of human rights leader Jesús María Valle.
