This Tuesday, a decision of the Supreme Court of Justice was known, in which it orders for the next 48 hours suspend the use of 12 gauge shotguns by the Mobile Anti-Riot Squad (Esmad), until the existence of guarantees for the responsible and measured use of said instrument is verified.
“Order the Mobile Anti-Riot Squads of the National Police (Esmad) and any institution that carries out“ Police activities ”that, within 48 hours of the notification of this ruling, suspend the use of 12 gauge shotguns, until after exhaustive verification, verify the existence of guarantees for the responsible and measured reuse of said instrument “, indicates the order of the Court.
The decision of the Court is given by an action of protection that more than 20 people presented against the President of the Republic, the Minister of Defense and the National Police, considering that with the use of force by members of the institution “the right to peaceful protest and life, among others, has been cut off.”
The Court orders that the Minister of Defense, within the next 48 hours, present an apology for the excesses of the public force, especially for those committed by the Esmad during the protests that took place in the country from of November 21 of last year, as happened with the Dilan Cruz case.
These apologies should be broadcast on radio, television and social networks. In the same way, the high government must issue an administrative act in which it orders all the members of the Executive Branch, maintain neutrality when non-violent demonstrations occur, even if they are aimed at questioning State policies.
The high court ordered that within 30 days, the Police, the Attorney General’s Office and the Attorney General issue a protocol that allows citizens and human rights organizations and entities linked to the United Nations, carry out verifications in cases of capture and transfer of people, during the development of any kind of rally, meeting or act of protests.
“When any participation of Esmad in public or private events is required, that body, in advance, must make available to the defender the list of commanders or unit heads of the personnel assigned for the required service and, likewise, the National Police must designate a common superior officer to serve as a link between the agents and the Ombudsman ”, points to the document.
