The defenders of Juan Camilo LLoreda and Harby Damián Rodríguez stated in the hearing against the dismissed patrolmen that they were providing a Police service when they had the confrontation with Javier Ordóñez.

In that sense, they asked Judge 29 of guarantees to decide whether the case should be tried by the Military Criminal Justice; however, she noted that she could not resolve the situation and sent the petition to the Superior Council of the Judiciary.

Jhon Olmos, one of Rodríguez’s lawyers, detailed in El Espectador that the request was made because of the “scene” that happened in the CAI of Villa Luz, west of Bogotá; there, according to investigators, Ordoñez died from a beating he received.

“The patrols exercise a task of vigilance, care and control and, although it is true that there is an ‘excessive use of force’, let’s put it like thisThis use is allowed within the Military Criminal Justice, because they are acts of service ”, said the lawyer.

In addition, Olmos pointed out in the newspaper that Lloreda and Rodríguez (the latter would have tried to make an attempt on his life after being captured) were wearing the uniform when Ordóñez was reduced on September 9.

“When you have the uniform and are part of the Public Force, you have that guarantee, so that, automatically, who must judge the police and military is the Military Criminal Justice,” added the lawyer.

However, the same justice of the military was the one that said that the case of the patrol cars was not their competence, and left the process in the hands of the Prosecutor’s Office, which this Saturday imputed the charges of aggravated torture and aggravated homicide, crimes that the uniformed men did not accept.

It is unknown when the Superior Council of the Judiciary will make the decision. Meanwhile, the hearing against Rodríguez and Lloreda, who would have tried to escape from justice, will continue this Sunday; They could impose an insurance measure.
