Superindustria issues order to Daniel Samper Ospina on data protection of children and adolescents

The Superintendency of Industry and Commerce issued a mandatory order to Daniel Samper Ospina, in order not to violate the rules on data protection of children and adolescents again.

The Superintendency of Industry and Commerce ordered Ospina:

• Refrain from processing personal data of minors (images) for marketing or advertising purposes without having obtained the prior, express and informed authorization of their legal representatives.

• Publish all the conclusions and the operative part of the decision of this authority on your official Twitter account and during the same term that the product was advertised (19 hours).

The decision was made after concluding that Daniel Samper Ospina performed data processing
personal data of three minors for commercial or marketing purposes, since
for 19 hours he spread a photo of the minors that he used
as part of an advertising piece to sell one of your products (board game),
without the prior authorization of the legal representatives of the minors.

The SIC took into account that Samper Ospina publicly acknowledged his mistake,
but he specified that said repentance does not eliminate the illegality of the conduct, nor
the competence of this Authority to fulfill its functions regarding the treatment
of the personal data of children and adolescents.
