‘Jorge 40’ served 12 years in prison and was expelled from Justice and Peace, for which reason several convictions await him upon his return, such as the crime of Professor Jorge Correa de Andréis.

EL TIEMPO reveals the exchange of letters that began on September 1 between Colombian authorities, addressed to the government of Donald Trump.

“Considering the criminal charges pending in Colombia against Mr. Tovar Pupo, the Republic of Colombia considers his return to the country of utmost importance in order to protect the rights of the victims to truth, justice, reparation and the guarantees of no repetition, “says Colombia’s requirement.

And he adds: “In this regard, the Ministry of Justice has requested information from the United States on Mr. Tovar Pupo, who was excluded from the Justice and Peace program and must return to Colombia in order to comply with the requirements of the judicial authorities and respond in the judicial process initiated against him on various criminal charges “.

The Consulate will prepare the passport when it receives the official request from ICE directly. The passport will be issued immediately and will be in that office within one day

EL TIEMPO also established that the former paramilitary prepares a statement in which he will say that he is willing to return, under security guarantees.

According to those close to the former paramilitary, he will insist on being welcomed into the Special Jurisdiction for Peace (JEP), after his expulsion from Justice and Peace.

This jurisdiction has already warned him that they would accept him as a civilian third party for his activities between 1996 and 1998, the time of his transition from rancher to paramilitary chief. But the rest of criminal activities would remain under the orbit of ordinary justice.

However, for Tovar it is clear that this is the only jurisdiction that guarantees the victims truth, justice and reparation. Furthermore, it would allow him to go free.

In any case, Colombia is already preparing all the procedures to guarantee that, if it obtains the endorsement of the United States for the return of ‘Jorge 40’ to the country, there are no obstacles that hinder his return.

“Once it is in the custody of ICE, the local office official will be responsible for requesting the travel document. In this regard, it is important to note that, by virtue of the procedure established by the American authorities, the Consulate will prepare the passport when you receive the official request from ICE directly. The passport will be issued immediately and will be in said office in the course of one day “, it is indicated in the letter signed by Ambassador Santos.

And, next line, he warns that “the flights of deportees from the United States regularly take place every month and the last of them departed today Wednesday, September 2”, which indicates that they would wait for the return of ‘Jorge 40’ for the first week of October.

It is a different case from Salvatore Mancuso, in legal terms, because the latter is still in Justice and Peace, which guarantees him a sentence of 8 years for the hundreds of crimes he committed.
