Prosecutor Francisco Barbosa will not declare himself impeded in the case of Álvaro Uribe – Investigation – Justice

Attorney General Francisco Barbosa will not declare himself prevented from hearing the case of former President Álvaro Uribe Velez.

According to official sources, the head of the accusing body considers that he is not involved in any of the causes of impediment established in the law, so he will not proceed to declare himself impeded.

In fact, Barbosa already made a first decision in the case, because although he could allow the investigation to be assigned automatically, he went to the legal authority to assign the process to an office himself.

The case will be handled by Gabriel Jaimes, chief prosecutor of the delegated prosecutors before the Supreme Court and former right-hand man of former attorney general Alejandro Ordóñez.

According to sources, Attorney General Barbosa has nothing to do with the process against former President Uribe, He has not participated in any of his actions, and therefore has no impediment.

This will be made known to the Supreme Court of Justice, which received an appeal from Senator Iván Cepeda, credited as a victim in this case, who challenged both Barbosa and his deputy prosecutor, Martha Mancera.

Cepeda argues that Although the attorney general and the deputy prosecutor would not be the direct investigators, they do have influence on how the processes are conducted within the prosecuting body and according to him, they do not give guarantees of impartiality in this case.

The senator also assured that since President Iván Duque has made public pronouncements in favor of Uribe in his judicial process, he should declare himself impeded, so if his challenge against the attorney general and the deputy prosecutor are successful, the Supreme Court will be the one to define an ad hoc prosecutor for the case, instead of President Duque sending a shortlist.

This Thursday, the file of the process for alleged bribery of witnesses and procedural fraud reached the Attorney General’s Office, after the The Investigation Chamber of the Supreme Court of Justice determined that it did not have the competence to continue the investigation against Uribe Vélez.

For now, the former president and former senator is still deprived of his liberty, since at the beginning of this month the Supreme Court sheltered him with house arrest. Uribe’s defense has already filed a document with the Prosecutor’s Office asking for his immediate release.
