Court annulled the election of Carlos Maya as mayor of Pereira – Other Cities – Colombia

In a first instance ruling of the Contentious Administrative Court of Risaralda it was declared this Tuesday the partial nullity of the administrative act that proclaimed the election of Carlos Alberto Maya López as mayor of the municipality of Pereira for the period 2020-2023.

The decision also canceled the credential delivered by the National Registry in the name of Maya as the president of the capital of Risaralda.

This nullification process was initiated by citizens Catalina Ocampo and Émerson Jaimes, who denounced that officials and contractors were allegedly pressured during the last administration of the city to refer, apparently, names of potential voters who would support Carlos Maya’s campaign for mayor.

In addition, the Court requests that copies be certified to the Office of the Attorney General of the Nation so that it may investigate Messrs. Fredy Eduardo Ruano López and Diego Fernando Bonilla Ríos. These two former officials of the past mayor’s office, whose president was Juan Pablo Gallo, are pointed out “For the alleged participation in politics while they held the positions of private secretary of the Mayor’s Office of Pereira and director of Digital Services and Online Government for the year 2019 ”.

This decision will be appealed to the Council of State, as announced by the Pereirans’ president through his social networks.

“I have just been informed about the decision of the Administrative Litigation Tribunal of Risaralda to declare the nullity of my election as mayor of Pereira”,
stated.

The president added that the process will continue before the Council of State to demonstrate that there was no illegality, as stated by the Attorney General’s Office. For now, after the appeal, Maya would remain in office pending a second instance ruling.

“The Court maintains that the voter was constrained, but there is no evidence. There are officials and ccontractors who decided to support our campaign, but we did not offer gifts or anything in return ”, he pointed.

The president added that in his campaign technology was used to build a database that allowed information to be shared, to gain followers and to retain voters.

“We use this database called Kontacto, but this application was never used for electoral constraint,” he added.

Last October, when the local elections were to be held, the then mayor of Pereira, Juan Pablo Gallo, was suspended by the Attorney General’s Office, entity that investigated him for alleged improper participation in politics. Due to this situation, he was unable to complete his mandate.

The control body, At the time, it announced that it would investigate whether Gallo had requested endorsements for the candidacies of various candidates.
