The 37 criminal court of knowledge of Bogotá sentenced the former head of the National Narcotics Directorate (DNE) Carlos Albornoz Guerrero to 19 years in prison, for irregularities in the handling of mafia assets.

Specifically, he was sentenced for the irregularities in the sale of the Villa Country shopping center in Barranquilla.

The judge did not grant the house arrest and considered that he must pay the sentence deprived of his freedom.

It also established the payment of a fine of 5,336 million pesos.

The defense representation announced that it will appeal the decision to be reviewed in the Superior Court of Bogotá.

Albornoz’s defense requested that the hearing be postponed as there was no communication from the site where the former official was deprived of his liberty. The judge denied that request and said that the defendant’s lawyer was present and that the case has already been very long and must be terminated, at least at this stage.

The judge said that Albornoz arbitrarily appointed Camilo Bula Galeano as liquidator and made decisions that even led to falsehoods for Bula to act in the sale of a property in Barranquilla. He indicated that the property was sold at a lower value than the real one, which translated into an economic and illegal benefit for those who participated in the business.

Likewise, the judicial official indicated, the accusation against Albornoz occurred in January 2013 and seven charges were imputed and that the delay that occurred in the criminal process led to the prescription of several crimes.

He even pointed out that from the moment he read the meaning of the ruling to date, other crimes have been prescribed and only the conviction for embezzlement is issued.

It indicated that it was insisted that an exclusive prosecutor be appointed for the case to avoid further delays and delays that would jeopardize the proper administration of justice and the rights of the parties.

Albornoz had been acquitted in two other processes linked to irregularities in the adjudication of property seized by the authorities.
