An unusual legal confrontation has just occurred between the prosecutors who were legalizing the capture of Jhon Fredy Zapata Garzón, alias ‘Messi’ or ‘Candado’, and one of the lawyers who is part of the defense. Everything was recorded in audios that EL TIEMPO obtained exclusively (see note below).
Zapata Garzón was captured by the Prosecutor’s Office and the Police on December 1 in an operation for the extinction of ownership for about 4 billion pesos. At the time, the prosecutor Francisco Barbosa indicated that this organization would be associated with the Clan del Golfo.

It is about the once iron prosecutor, who persecuted from Medellín and then in Bogotá to dozens of drug trafficking and hit man structures. In fact, she became one of the most feared and guarded civil servants in the country.

The judicial grab
The judicial official stressed that the former prosecutor fought criminals from the so-called Office to the Gulf Clan, passing through all structures of that organization.

The prosecutor, when intervening before the guarantee judge, assured that Dairo Antonio Úsuga, alias Otoniel, even put a price on the former prosecutor Carrasquila, while she persecuted him: “That she manifest in the audio out loud if there is an impediment on her part” reiterated the official of the Prosecutor’s Office, noting that this hearing was precisely to decide the legal fate of people associated with the so-called Gulf Clan.

Incapacity?
In turn, ex-prosecutor Carrasquilla demanded respect from her partner because she never called herself the iron lady, but on the contrary, it was a qualifier that some media gave her.
At the hearing, Carrasquilla clarified that he not only carried out actions against the Clan del Golfo but also against other criminal organizations when he served as the prosecutor’s office against organized crime.
She assured that since February 2020 when she ceased to belong to the Prosecutor’s Office, her capacity as a lawyer allows her to provide her legal services.

The lawyer explained that although the hearing was going to take place for a case opened since 2019, at that time she worked in the delegate for Citizen Security of the Prosecutor’s Office and did not know of cases related to the so-called Gulf Clan.

And she was emphatic that she was not the direct head of the prosecutors present at the hearing and that for this reason she rejected the request to declare herself impeded.
EL TIEMPO consulted the lawyer Claudia Carrasquilla and was emphatic in pointing out that she does not want her name to be related to that organization because she is a substitute defender for Horacio Luna, the main defense attorney for some of those captured in the operation of the Prosecutor’s Office and the Police.
At the end of the diligence, the defense of the captured also asked to suspend the hearing, noting that the judge was not competent from the territorial point of view, as in his opinion that hearing should have been held in the coffee region and not in the Medellin city.

Those captured were deprived of liberty until a final decision is made on this request.
