Supertransporte orders Avianca to rectify alleged resumption of flights

That is why the Transport Superintendency issued an administrative measure in which it requires Avianca “to immediately rectify all the information and each one of the advertising pieces issued and in which manifestations have been included that give certainty that as of the May 11 the flights will be restarted or that allow inferring this fact ”.

The airline will have 24 hours to comply with the order, which also includes “immediately issuing an official statement addressed to the general public where they are excused from users for the confusion that may have been generated.”

Lastly, the entity asked Avicna “to refrain from issuing any type of advertising that creates confusion or misleads air transport users in relation to the reactivation of the services to be offered” and demanded to report on “the number of tickets sold from the date of the advertising campaign’s dissemination to the communication of this measure, indicating the user’s contact details and their itinerary ”.

President Duque himself addressed the company this Friday saying that he could not sell tickets after May 11. Avianca responded at the time, but for the superintendency both things were not enough due to the impact the announcement had.

In this sense, he pointed out that the advertising disclosed this Thursday, April 30, “misleads users of the air transport service, since they offer an expectation that does not generate security when making the consumption decision.”

In addition, he indicated that the campaign “generated an impact on a large number of users causing damage to the general interest” and “the rules that establish the rights of air transport service users are violated.”

The entity also details that the rectification message must meet a series of conditions:

  • “It must be preceded by the following announcement:‘ By order of the Transport Superintendency, Avianca rectifies its advertising. “
  • You must indicate to users clearly, precisely, timely and truthfully that the operation of domestic flights is not yet authorized, therefore, there is no certainty regarding the date on which it will be allowed to operate again and consequently resume flights.
  • It will be carried out through the same means of dissemination used by the Avianca company, even when these have not been indicated in this administrative act.
  • The rectification message will comply with the same characteristics of the initial publication, that is, the same letter, size, location, periodicity and element that complies with it ”.
