Magura Chief Magistrate Mohammad Ziaur Rahman set an example by using his symbolic name in the verdict of the case to protect the dignity of a female victim of pornography. In the verdict handed down on Monday, she called the university student ‘Kalpa’.

This is the first time in the history of the country that the aggrieved person or the candidate announces the verdict with the symbolic name instead of his own name.

The college student filed a case in 2016 on charges of preservation and promotion of pornographic images. The defendant Jubayer Hossain was found guilty on Monday and sentenced to two years in severe prison and a fine of Tk 1 lakh based on the evidence in the case.
Not only that, the wise judge has instructed that the victim will receive compensation for this fine. The verdict did not mention the real name of the victim but “Kalpa” as a symbolic name.

According to judicial sources, Jubayer Hossain developed a love affair with ‘Kalpa’ after a long fight. At one point, he took some personal pictures of the girl on his mobile phone. Upon learning of the affair, Kalpa ends his relationship with her. Jubayer tried to establish a new relationship saying that these images had been removed. But without agreeing to that, he spreads the images on his mobile phone through various means. In this situation, Kalpa presented a case on April 20, 2016 at the corresponding police station.

Regarding the verdict in the case, the plaintiff’s attorney, Wajeda Begum, said: “After the police investigation, the wise judge Ziaur Rahman found the defendant guilty on Monday and issued a landmark verdict in the case.”

He said that as there was no precedent for such a verdict in the Bangladeshi judicial system, a wise judge had rendered a verdict in the Nirvaya case under the pseudonym of the Supreme Court of India and in the British Supreme Court instead of naming ‘N1 ‘and’ H1 ‘instead of the real names of the two defendants. He gave an example.

Shafiquzzaman Bachchu, attorney for the defendants in the case, said: “We are in a backward position compared to developed countries in terms of empowerment and freedom for women. Britain has prohibited the disclosure of the identity of the victim. In our neighboring country, India, it is also forbidden to reveal the identity of the victim of sexual crimes, including rape.

In our country also, according to article 14 of the 2000 Law for the Prevention of Violence against Women and Children, certain disclosure of the victim’s identity is prohibited. But nobody obeys, nobody obeys. The fact that the verdict was rendered without revealing the identity of the victim is a positive aspect.

In fact, in all three cases above, the wise judge Ziaur Rahman has set an example by planting trees and reading books on the liberation war rather than conventional incarceration.
