Four high-ranking Supreme Court attorneys have been appointed as amicus curiae to seek the legal opinion of expert lawyers on whether the home of the late pilot Mostafa Jaglul Wahid, brother of musician Ferdous Wahid, can be bequeathed to a foreigner. The four amicus curiae are: former Attorney General AF Hassan Arif, Chief Counsel Kamal-ul-Alam, Md. Nurul Amin and Kamrul Haque Siddiqui.

Justice Md. Nazrul High Court Islam Talukder and Judge Ahmed Sohail approved the order on Thursday.

They have been asked their opinion on whether a Muslim can marry a Hindu woman under Special Marriage Law 162 and whether there is a legal basis for Anju Kapoor, an Indian citizen, to bequeath the entire house to Jaglul Wahid as his wife .

The next hearing in the case is scheduled for January 12. So far, the CO of Gulshan Police Station has been instructed to provide security for the two sisters. Also, if Mostafa Jaglul Wahid has an account with Mercantile Bank, Citibank, BRAC Bank, Eastern Bank, Standard Chartered Bank, IFIC Bank and both parties want an account statement, the administrator in question will give it to them. Later both parties will send it to the court. Additionally, Citibank’s file has been ordered to be submitted to the court.

Attorney Manzil Morshed was the attorney for the two daughters in court. Masood and Sobhan were Anju Kapoor’s lawyers. Assistant Attorney General AKM Amin Uddin Manik represented the state.

Earlier, on October 26, the High Court ordered the Officer-in-Charge (CO) of the Gulshan Police Station to take steps to allow Mushfiqa Mostafa and Mobashbera Mostafa, two daughters of the late Mostafa Jaglul Wahid, to enter their ancestral home.
