Who is the Legal Director-Attorney General of the state? There is no end to speculation in court on this. There is curiosity everywhere about who the government will appoint to this important constitutional state office. The post is now vacant due to the recent death of Mahbubey Alam, the oldest attorney general in the history of Bangladesh. Since his death, the government has also begun work to appoint a new attorney general.
It is known that in the absence of Mahbubey Alam, Sham Rezaul Karim was being considered Attorney General. But when he was elected minister in the Eleventh Parliamentary Election, a huge void had been created between advocates for the Awami League. However, the government is looking for an honest and highly qualified attorney. Some names have already come up in the discussion. Among them are Attorney AM Amin Uddin, President of the Supreme Court Bar Association, Attorney Mansurul Haque Chowdhury and Attorney Ajmalul Haque QC. In addition, the names of Senior Attorney Kamrul Haque Siddiqui, Additional Attorney General Murad Reza, Momtaz Uddin Fakir and the newly appointed Attorney General SM Munir are also under discussion. Attorney Nihad Kabir has also been nominated for the position of Attorney General from among the attorneys.
Article 64 (1) of the Constitution states: “The President shall appoint a qualified person to be a judge of the Supreme Court to the post of Attorney General of Bangladesh.” (2) “The Attorney General shall perform all the functions assigned by the President.” (3) The Attorney General shall have the right to present his case in all courts in Bangladesh for the performance of his duties. (4) The Attorney General will remain in office for the period that the President can be satisfied and will receive the remuneration set by the President.
According to a responsible government source, only qualified and suitable individuals will be appointed from among professional lawyers to fill this important position. When asked, Justice Minister Anisul Haque told Jugantar: “We are thinking about filling the Attorney General vacancy. Let’s see.” In response to a question, he said, “If a spot is vacant, there will be competition.”
The name of Attorney AM Amin Uddin, President of the Supreme Court Bar Association, is being discussed as Attorney General. He wrested the leadership of the Supreme Court bar from pro-BNP lawyers and became president twice in a row. This personable attorney has already become everyone’s favorite. As a result, many are talking about the possibility of his appointment as Attorney General.
Murad Reza can also be appointed Attorney General. Because he has long experience handling cases on behalf of the state. He has participated in hearings in several important cases in the absence of the Attorney General on various occasions. In the past, there have been cases of appointments of the Additional Attorney General to the Attorney General.
There are also rumors that senior attorney Barrister Ajmalul Hossain could be appointed Attorney General for QC. He is the only lawyer in Bangladesh to serve as the QC of the Queens Council, UK. The name of the lead attorney, attorney Kamrul Haque Siddiqui, has also come up in the discussion amid rumors of a change in Attorney General at different times. This attorney has a reputation for honesty and efficiency in the relevant sectors. Many believe that lead attorney Mansurul Haque Chowdhury may also be appointed Attorney General. Criminal law expert Mansurul Haque Chowdhury is popular with stakeholders. The additional name of Attorney General SM Munir is also heard on the list of new appointments of the Attorney General. Lawyer Munir, former secretary of the Supreme Court Bar Association, has been appointed Additional Attorney General. Many are considering the issue as the government’s focus on it.
Lawyer Nihad Kabir, Chairman of the Dhaka Metropolitan Chamber of Commerce and Industry (MCCI), will also be heard as the new Attorney General. The government, which believes in empowering women, may also appoint attorney Nihad Kabir as the country’s first female attorney general.
Mahbubey Alam, the thirteenth attorney general of Bangladesh, died on September 28 at the Combined Military Hospital (CMH) in Dhaka.
