The first verdict in the history of Bangladesh will be released on Wednesday (September 9) in the case brought regarding the death of the defendant in police custody. This will be the first case after the enactment of the Torture and Death in Custody (Prevention) Act in 2013. Dhaka Metropolitan Sessions Judge KM Imrul Kayesh will announce the verdict at noon on Wednesday (9 September).
On the night of February 8, 2014, Johnny, the driver of a private company, had a fight with Sumon, a police source, at a yellow ceremony in the area of the Iranian camp of Mirpur. That same night, it was alleged that some policemen, including the then Deputy Inspector of the Pallabi Police Station, Zahid, detained Johnny and tortured him to death.
Subsequently, on August 8 of the same year, Imtiaz Hossain Rocky, brother of the murdered Johnny, filed a lawsuit against five people, including the then Deputy Inspector of the Pallabi Police Station Zahidur Rahman Zahid, in the Metropolitan Sessions Court of Dhaka.
When asked about the expectation of the verdict, Dhaka Metropolitan Prosecutor’s Office prosecutor Abdullah Abu said: “The first verdict on the Torture and Death in Custody (Prevention) Act will be announced today (9 September).” The defendants in the case are SI Zahid and five other people. The maximum penalty under this law is life imprisonment. We expect the maximum punishment for the defendants in the state’s verdict.
Meanwhile, the defendant’s lawyer, Farooq Ahmed, said: “The accusations made against the defendant are not true. The prosecution could not prove the allegations. Hopefully, the accused will be acquitted.
Earlier, on August 24, Dhaka Metropolitan Sessions Judge KM Imrul Kayesh set the verdict date after presenting the arguments of both parties.
The other four defendants in the case are Rashedul Islam (Deputy Inspector), Kamruzzaman Mintu (Deputy Deputy Inspector) and the police sources Rashed and Sumon.
According to the details of the case, Imtiaz Hossain Rocky, brother of the deceased, presented the case in the Dhaka Metropolitan Sessions Court on August 8, 2014, alleging that Johnny was tortured and killed in police custody. That day, the court accepted the case and ordered a judicial investigation. Then, on February 17, 2015, after the judicial investigation, a report was presented to the court accusing 5 people. On April 17, 2016, the court brought charges against five people, including Deputy Inspector Zahid. Of the total of 26 witnesses in the case, 21 have testified.
