A Dhaka court sentenced two defendants to death in the murder case of the child Khandaker Samiul Azim Wafi (5) at Naboday Housing in Adabar, the capital. At the same time, they have been fined five thousand rupees. Judge Sheikh Nazmul Alam of the Dhaka-4 Special Court delivered the verdict on Sunday.
During the verdict, the judge observed that the confessional statements and the testimony of the defendants in the murder of Shishu Samiul demonstrated that the innocent boy Samiul must have been the victim of an extramarital affair. Therefore, even if he is not directly involved in the murder, he cannot gain sympathy for the mother’s persuasion and support to kill her only son. The death penalty is the only appropriate punishment.
The judge further observed, “Esha was involved in an extramarital affair with Shamsuzzaman Arif alias Bakkur on the basis of a love story. Samiul, his own son, saw the incident of their immoral physical relationship. Fearing that her husband might tell her about the matter, Esha persuaded her boyfriend to kill the boy. At his instigation, Arif kidnapped and killed Samiul. Evidence has shown that Esha has been in frequent contact with her boyfriend since Samiul was kidnapped. In the end, he killed the boy and threw him in a sack on the street.
Shishu Samiul’s mother, Esha, was out on bail in the case. He did not appear in court on November 23. The court canceled his bail and issued an arrest warrant against him. On the other hand, Shamsuzzaman Arif alias Bakku, one of the defendants in the Samiul murder case, escapes on bail from the High Court after his arrest.
According to the file, the boy Samiul was strangled to death on June 23, 2010 after witnessing an immoral incident with Shamsuzzaman Arif alias Bakkur. Later, the body was put in the refrigerator to hide it. Subsequently, the body was put in a sack and dumped on the road on June 24 of that year. On the same day, Samiul’s body was recovered from the Naboday housing area of Adabar in packed condition.
The late Samiul was an English playboy at Greenwood International School in Naboday Housing.
The father of the late Samiul filed a murder case at the Adabar police station the same day. After the arrest, defendants Ayesha and Shamsuzzaman made confessional statements in court about their involvement in the murder.
The investigating officer in the case, the Officer-in-Charge (CO) of Adabar Kazi Police Station Shahan Haque, filed a charge sheet against the two on October 25, 2012 at the Main Metropolitan Magistrates Court in Dhaka. On February 1, 2012, the court brought charges against the defendants. During the trial, Adabar OC Kazi Shahan Haque Police Station filed a charge sheet against Esha and Bakkur on October 25, 2012. On February 1, 2012, the court brought charges against the defendants. During the trial of the case, the court took the testimony of 22 people.
