The trial of six defendants in the notorious Rifat Sharif murder case in Barguna, including his wife Ayesha Siddique Minni, has come to an end. Now after sending the death reference to Superior Court, the appeal process will begin. Convicted persons must appeal to the higher court within seven working days.
It is known that all the documents of the case including the verdict for the reference to the death of the convicts could reach the Superior Court on Sunday (October 4). Barguna Court sources said that the death references of 8 defendants, including Minni, will reach the High Court in time.
As a general rule, all procedures in the death referral case are referred to the Superior Court for approval. The defendant may file an appeal within seven days after the verdict reaches the Superior Court.
Basically, the death sentence of a defendant requires the approval of the Superior Court, which is known as a death reference case. However, convicts will have the opportunity to appeal and imprison against the trial court’s verdict.
The reference to death is a process in which the death sentence is heard and resolved in the higher court in accordance with the provisions of the law, even if the convicted person does not appeal on his own. The Superior Court can make the necessary decision after examining the judgment of the Judicial Court.
Sources from the Barguna District and Sessions Court of Justice said that they are working to prepare all the documents, including the verdict for the death reference of those sentenced to death.
Lawyers said that when a court sentences a convict in a criminal case, the approval of the Superior Court is required for the execution of the sentence. Therefore, the judicial court in question sent all the documents of the case to the High Court under article 374 of the Code of Criminal Procedure, which is known as the Death Reference.
After receiving the document, the Death Reference Section of the Superior Court examined and prepared the paper book of the case. It was then presumed that the case was ready for hearing. However, in some of the disputed cases, the manual was prepared on the basis of priority by order of the Chief Justice.
On September 30, Barguna District Judge and Sessions. Ashaduzzaman announced the verdict in the case.
Six of the 10 adults convicted were sentenced to death and fined 50,000 taka each. The other four were acquitted.
The verdict said those sentenced to death can appeal within seven working days of the order.
The verdict further stated that in order to approve the death sentence, the documents containing the verdict and the sentence had to be sent to the Superior Court Division in accordance with the provisions of article 374 of the Code of Criminal Procedure.
Those sentenced to death are- Md. Rakibul Hasan Rifat alias Rifat Faraji, Al Qayyum alias Rabbi Akon, Mohaiminul Islam Sifat, Rezoan Ali Khan Hridoy alias Tiktak Hridoy, Md. Hasan and Ayesha Siddique Minni.
Md. He was released. Musa (fugitive), Rafiul Islam Rabbi, Md. Sagar and Kamrul Islam Simon.
It can be mentioned that Rifat Sharif and his associates hacked Rifat Sharif in front of his wife Minni in front of Calix Academy on Barguna Government College Road around 10:30 am on June 26, 2019. Rifat was transferred to Barguna General Hospital in critical condition. He was admitted to Barisal Sher-e-Bangla Medical College Hospital for advanced treatment. Rifat died while receiving treatment there.
Later, Rifat’s father, Dulal Sharif, became the plaintiff and named Sabbir Ahmed aka Nayan Bond as the main defendant and brought a murder case against five or six other people at the Barguna police station. Minni was first named the lead witness in the case by Rifat’s father.
Later on the morning of July 2, Nayan Bond, 25, was killed in a ‘shootout’ with police in the Purakata Ferry Ghat area of Burirchar Union at the district headquarters.
On July 17 of that year, 20 days after the murder, Minnie was taken from her father’s home to Barguna Police Lines for questioning. After questioning, the police arrested Minni the same night he appeared to be involved in the murder.
Subsequently, on August 29 of the same year, the Superior Court granted Minni bail. Subsequently, on September 1, 24 people, both older and younger, were charged; The charge sheet was filed in court in two parts. Of these, 10 are adults and 14 are minors.
Charges were brought against 10 accused adults on January 1. After the testimonies and arguments, the verdict was announced on September 30.
