The number one judge of the Dhaka trial court, Abu Zafar. Kamruzzaman announced the verdict in the sensational case on Sunday.
The three defendants in the case, the bus driver Hanif Paribahan Jamal Hossain, his assistant and brother Faisal Hossain, and supervisor Johnny were present at the time.
Payal’s uncle, Golam Sarwardi, the plaintiff in the case, has expressed satisfaction with the maximum sentence imposed on the Biplob defendants.
On the other hand, Abul Kalam Azad, one of the defendants’ lawyers, said they appealed the verdict.
Saidur Rahman Payal
Saidur Rahman Payel, a student at North South University, disappeared on the night of July 21, 2016 after leaving Chittagong for Dhaka in a Hanif Paribahan bus with two friends, Akibur Rahman Adar and Mohiuddin.
Gazaria police recovered Payel’s body from a canal under the Bhaterchar bridge in Munshiganj Upazila on July 23.
Johnny, Hanif Paribahan’s supervisor, was arrested at Motijheel in Dhaka and the driver Jamal Hossain and his assistant Faisal Hossain were arrested in Arambagh.
Citing his testimony in court, police said that Payal got off the bus in a traffic jam in the Gazaria area to urinate. When the bus started to move, he ran and got up, knocked on the door and lost consciousness. Instead of taking him to the hospital after seeing blood coming out of his nose and mouth, the driver and supervisor took the bus to Dhaka on the lower canal of the Bhaterchar Bridge to avoid responsibilities.
His family also alleged that the bus driver smashed his face to hide his identity before throwing him into the canal from the bridge in an unconscious state.
Pawel, a fifth-semester BBA student at North South University, lives in the CDA residential area of Halishahar in Chittagong. His father Golam Mawla and his older brother Golam Mostafa are expatriates from Qatar. Payal went to Chittagong with the news of his older brother’s son. The incident took place on the way back to Dhaka from there.
After Pawel’s death, his uncle Golam Sarwardi Biplob filed a murder case against driver Jamal Hossain, his assistant Faisal Hossain and supervisor Johnny at Gazaria Munshiganj Police Station.
Following the investigation, the Gazaria police station filed a statement of charges against the three on October 3 of that year. Initially, the case was heard in the Munshiganj Additional District and Sessions Court of Judges, but at the request of Payel’s family, the Department of Public Security of the Interior Ministry transferred the case to the Chittagong Speedy Trial Court.
On April 2, 2019, the acting judge of that court, Abdul Halim, brought charges against the three defendants and ordered the start of the trial. There, too, the testimony began.
But at the request of the accused, the case was sent to the Dhaka Speedy First Instance Court on November 16, 2019 by order of the High Court.
The defendants summoned (recalled) the state witnesses who testified in the previous court in the Dhaka court and asked for cross-examination. If the judge agrees, the evidence is taken from the beginning. As a result, the verdict was postponed.
