No case without auto insurance: BRTA

Insurance against third-party risks is not mandatory under the new road transport law. The Bangladesh Road Transport Authority (BRTA) has said that no case can be brought without insurance of any vehicle.

BRTA President Nur Mohammad Majumder said in a memorandum to the Inspector General of Police on Thursday (October 1). He said that under section 109 of the 1983 Motor Vehicle Ordinance insurance against third party risks was mandatory and section 155 provided for a penalty. However, it is not required under subsections (1), (2) and (3) of section 80 of the Road Transportation Act 2017.

The three subsections are:
1. The owner or organization of a motor vehicle may, if it so wishes, insure the life and property of the specified number of passengers for the transportation of any motor vehicle owned by it.

2. The motor vehicle owner or organization will insure the motor vehicle that operates under their orders regularly and the loss or damage of the motor vehicle will be covered by insurance and will receive appropriate compensation from the insurer.

3. In the event of a motor vehicle accident or damage or damage, no compensation can be claimed from the financial assistance fund established under section 53 for that motor vehicle.

That is, insurance against third party risks is not mandatory under this section and there is no penalty under this Act if it is violated. If there is no third party risk insurance in this law, there is no opportunity to bring a case against the motor vehicle in question or the owner of the motor vehicle under the 2018 Highway Transportation Act. BRTA asked Smar to take the necessary measures to inform all interested parties about the matter.

When asked about the matter, BRTA Chairman Nur Mohammad Majumder told the Bengali Tribune: “Third-party risk insurance is not mandatory under the new road transport law. So if you don’t have insurance, you can’t. sue on the road. We’ve informed the police about it.
