The lawyer told the Bengali Tribune on Tuesday (October 20) after a bail order was filed in a case brought by the Election Commission.
Regarding the case brought by the Electoral Commission, Shahdin Malik said that if there is any allegation of breach of oath against a member of Parliament, it is the responsibility of the President to address it. Therefore, if a member of parliament violates the law or the code of conduct, it is the responsibility of the president.
Regarding the leak of Nixon Chowdhury’s conversation on social media, Shahdin Malik said that article 43 of the constitution guarantees correspondence and communication of all citizens. The Telecommunications Regulation Act of 2001 states that the government can order a telephone company to record (a person’s conversation) in the interest of national security and public order. In that case, the search warrant will be by order of the Minister of the Interior or the Minister of the Interior of the State. But no such order was made in the case of the Nixon Chowdhury record. Therefore, the publication of Nixon Chowdhury’s call log is a violation of the constitution, said one of the expert constitution lawyers Shahdin Malik.
Earlier, on October 15, the Electoral Commission (EC) filed a case against Deputy Faridpur-4 Mujibur Rahman Chowdhury Nixon. The district’s senior election official, Nawabul Islam, brought the case to the Charbhadrasan police station.
In the case, he was required to take legal action against Nixon Chowdhury in accordance with the rules of the Upazila Parishad Election Rules 2013 and the Upazila Parishad (Electoral Conduct) Rules 2018.
According to the statement, Deputy Commissioner Atul Sarkar called the central executive magistrate in the Charbhadrasan upazila by-election on October 10 and demanded an apology. At the same time, after arresting an election agent while voting and smoking in front of a voting booth on Election Day, the Charbhadrasan Upazila Executive Officer, the Deputy Commissioner of Bhangar (Lands) and the Acting Executive Magistrates used language contemptuous and insulting. It is alleged. He later applied to the High Court for bail in the case.
