Dhaka: The court has allowed Jamaat leader Delwar Hossain Sayedee, who was sentenced to death for crimes against humanity, to appear in court in a minibus instead of a prison van at his expense to hear a case of embezzlement. zakat funds of the Islamic Foundation.
Judge Syeda Hosne Ara of the Dhaka-1 Temporary Special Court, established at the Alia Madrasa land in Bakshibazar in Old Dhaka, approved the order on Monday (December 26) in response to a guilty plea from the defendant.
The defendant’s lawyer, Mujahidul Islam Shahin, told banglanews: “Taking into account her age, physical condition and social condition, we request to take Maulana Sayedee to court in a minibus instead of a prison van.” The court granted that request.
Meanwhile, the defendants could not prepare for the hearing as they did not receive the case documents and requested time for the hearing. The ACC opposed the request and filed a complaint. After the hearing, the court granted the request and set January 11 as the next day for the hearing.
Abdus Sobhan Tarafdar, Mujahidul Islam Shaheen and Matiur Rahman Akand appeared for Sayedee and Mosharraf Hossain Kajal appeared for the ACC.
On the occasion of the hearing, Sayedee was presented to the temporary court set up on the Alia Madrasa grounds in Bakshibazar of Old Dhaka from Kashimpur jail at 9.50 am on Monday. After the hearing, they took him to Kashimpur.
Six defendants, including Delwar Hossain Sayedee in the case. The other five defendants are Mohammad Lutful Haque, former director of the Islamic Foundation, Maulana Abul Kalam Azad, former chairman of the Mosque Council for Community Advancement, Mia Mohammad Yunus, Bandhujan Parishad chief secretary, Tofazzal Hossain , former president of the Center for Islamic Social Welfare and Mohammad Ali, deputy director of the Islamic Foundation mosque council. Among the accused, Delwar Hossain Sayedee is in jail. Abul Kalam Azad and Abdul Haq escaped. The other three defendants are out on bail. The name of former minister of state for religion Mosharraf Hossain Shahjahan was removed from the charge sheet.
Ayub Ali Chowdhury, former director (finance and accounting) of the Islamic Foundation, presented the case to Sher-e-Bangla Nagar Police Station on May 24, 2010, alleging misappropriation of zakat funds. After investigating the case, ACC Deputy Director Wazed Ali Gazi filed a charge sheet in court on April 30, 2012.
Delwar Hossain Sayedee is currently in prison on a death sentence for crimes against humanity.
